Related material such as previous rezones
is provided for reference. This letter provides information to help the Dane County Zoning
Division spearhead the necessary Zoning Map Amendments.
The goal of the September 10 meeting was to clarify the steps to follow on the rezone that the
Town of Oregon was undertaking and make sure the different agencies involved were
communicating. The attendees were Monica Slagth (Town of Oregon Planning Commission),
Diane Milligan (DATCP), John Hagengruber(DC Zoning) and Eva Serra (DC Planning).
At the meeting, Milligan explained the DATCP orders for the Town of Oregon Certification
(see letter attached). DATCP's main concern is to make sure the zoning certificates are
issued for only "eligible tax parcels" -parcels classified as agricultural preservation on the
Town Plan map certified by LWCB. The final orders of DATCP do not explicitly require an
amendment to the Dane County Zoning Map to make it consistent with the Town Plan Map
certified by LWCB. However, inconsistency of both maps is a source of problems. Without
consistency, Dane County Zoning can not be able to issue a Zoning Certificate for a parcel
solely based upon the Zoning Map as it is presently done. The Town Plan Map would need to
be checked to see if those parcels are within the agricultural preservation area.
The Town of Oregon Planning Commission is taking the appropriate actions to preserve its
future tax credits and has consistently followed the feedback and recommendations received
from DATCP and Dane County. The DATCP Staff Comments of December 1996 stated that
future certification was based upon compliance with the following:
"The map for the Town of Oregon, and the results of the rezoning of inconsistent
parcels under findings of fact (10) must be resubmitted to the LWCB by July 1,
1998 in order to receive certification for 1998 and beyond."
The findings of fact(10) mentioned above are:
Acres (approx.)
