I <br /> LAND AND WATER CONSERVATION BOARD <br /> DANE COUNTY EXCLUSIVE DOCKET NO. q(�'�Z - 122- O60 .,0_ 2 <br /> AGRICULTURAL ZONING DECISION GRANTING CONDITIONAL <br /> ORDINANCE TEXT CERTIFICATION FOR 1996 AND <br /> 1997 ONLY <br /> Pursuant to ss . 91 . 06 and 91 . 78, Wis . Stats . , Dane County asks the <br /> State of Wisconsin Land and Water Conservation Board to certify the <br /> text of the Dane County Exclusive Agricultural Zoning Ordinance. <br /> The Land and Water Conservation Board considered this matter on <br /> October 1, 1996, and adopted the following decision: <br /> FINDINGS OF FACT <br /> (1) The State of Wisconsin Land and Water Conservation Board <br /> (LWCB) is an agency of the State of Wisconsin. The LWCB is <br /> attached, for administrative purposes, to the State of Wisconsin <br /> Department of Agriculture, Trade and Consumer Protection <br /> (department) . The department is responsible for providing <br /> administrative support to the LWCB. <br /> (2) The LWCB and the department are jointly responsible for <br /> administering Wisconsin' s farmland preservation program under ch. <br /> 91, Wis . Stats . The farmland preservation program is designed to <br /> preserve agricultural lands and open spaces, to promote soil and <br /> water conservation, to promote orderly land use planning and <br /> development, and to provide tax relief to owners of farmland <br /> covered by the program. <br /> (3) In order to participate in the farmland preservation <br /> program, a county must adopt an agricultural preservation plan <br /> which is certified by the LWCB. In order to be certified by the <br /> LWCB, a county agricultural preservation plan must comply with <br /> standards specified under subch. IV of ch. 91, Wis . Stats. Among <br /> other things, a county agricultural preservation plan must <br /> designate agricultural preservation areas which are to be preserved <br /> for agricultural use . <br /> (4) Under the farmland preservation program, a county, town <br /> or municipality may adopt an exclusive agricultural zoning <br /> ordinance. If the ordinance is certified by the LWCB, owners of <br /> farmland zoned for exclusive agricultural use may claim farmland <br /> preservation tax credits.
