1 (LI IIII LLII lI A I (/A/(/I I U f'I UIt A A ("6, LA,AAA <br /> Notice of Right to Rehearing <br /> A party adversely affected by this final decision may file a written petition for rehearing <br /> under s. 227.49, Stats., within 20 days after he or she is served with this decision under <br /> s. 227.48. A petition for rehearing, if any, shall specify in detail the grounds for <br /> rehearing. The petition shall specify each finding of fact and each conclusion of law <br /> which is disputed by the party, as well as the basis or grounds for the party's contrary <br /> position on that finding or conclusion. <br /> The petition for rehearing shall be sent to the Wisconsin Land and Water Conservation <br /> Board, do the Wisconsin Department of Agriculture, Trade and Consumer Protection, <br /> Division of Agricultural Resource Management, 2811 Agriculure Drive, P.O. Box <br /> 8911, Madison, WI 53708-8911. <br /> Rehearing will be granted only on the basis of some material error of fact, some <br /> material error of law, or the discovery of new evidence sufficiently strong to reverse or <br /> modify the order, and which could not have been previously discovered by due <br /> diligence. <br /> The Wisconsin Land and Water Conservation Board may ask the department to appoint <br /> an impartial hearing examiner to conduct a contested case hearing on behalf of the <br /> Board. The hearing examiner will conduct the hearing under the provisions of ch. 227, <br /> Stats., and may schedule the hearing in the affected county. Any hearing examiner <br /> appointed to conduct a hearing shall prepare a proposed decision at the conclusion of <br /> the hearing for the Board. The Board shall consider the proposed decision, and may <br /> adopt, reject or modify the decision as it deems necessary. <br /> Notice of Right to Appeal <br /> A party adversely affected by this final decision may also seek judicial review under ss. <br /> 227.52 and 227.53, Stats., by filing a petition for judicial review within 30 days after <br /> he or she is served with this decision under s. 227.48. An affected party need not <br /> request a rehearing before requesting judicial review.
