CORRESPONDENCE/MEMORANDUM State of Wisconsin <br /> DATE: September 20, 1996 <br /> TO: Land and Water Conservation Board Members and Advisors <br /> FROM: David Jelinsk' I ATCP <br /> Land and Water r-esources Bureau <br /> SUBJECT: Agenda Item #5, Certification of Dane County Zoning Ordinance Text <br /> Recommended Action: Staff recommends that the Land and Water Conservation Board (LWCB) <br /> certify the Dane County exclusive agricultural zoning ordinance text for the year 1996 only with <br /> conditions. <br /> Summary: In 1993 and 1994, Dane County's ordinance text was certified with various conditions. <br /> The certifications were for limited terms and expired December 31, 1995. Dane County has not yet <br /> amended its ordinance to bring it into compliance with ch. 91, Wis. Stats., and the department's <br /> proposed rule. The rule is not yet final and may ultimately be modified. <br /> Dane County requests certification for 1996 to allow farmers to receive tax credits for 1996, and to <br /> provide additional time to the county to meet the requirements to be established under the final rule. <br /> Dane County fully expects certification, at this time, to be for a limited term and with conditions, as in <br /> the past. <br /> Materials Provided: As a final decision-maker on certifications of ordinance test, the LWCB is <br /> required to document the relevant findings of fact and conclusions of law for its decision. I am <br /> attaching the staff report, the letter of submittal by Dane County, a proposed decision, including <br /> findings of fact and conclusions of law. The LWCB may wish to consider the proposed findings and <br /> conclusions according to its final decision. <br /> Presenter: Janet Niewold will present the request by Dane county to extend their conditional <br /> certification through 1996.
