LAND AND WATER CONSERVATION BOARD <br /> DOCKET NO. <br /> DANE COUNTY EXCLUSIVE AGRICULTURAL ) DECISION GRANTING <br /> ZONING ORDINANCE TEXT ) CONDITIONAL CERTIFICATION <br /> FOR 1996 ONLY <br /> Pursuant to ss . 91 . 06 and 91 . 78, Stats . , Dane County asks the State <br /> of Wisconsin Land and Water Conservation Board to certify the text <br /> of the Dane County Exclusive Agricultural Zoning Ordinance. The <br /> Land and Water Conservation Board considered this matter on October <br /> 1, 1996, and adopted the following decision: <br /> FINDINGS OF FACT <br /> (1) The State of Wisconsin Land and Water Conservation Board <br /> (LWCB) is an agency of the State of Wisconsin. The LWCB is <br /> attached, for administrative purposes, to the State of Wisconsin <br /> Department of Agriculture, Trade and Consumer Protection <br /> (department) . The department is responsible for providing <br /> administrative support to the LWCB. <br /> (2) The LWCB and the department are jointly responsible for <br /> administering Wisconsin' s farmland preservation program under ch. <br /> 91, Stats . The farmland preservation program is designed to <br /> preserve agricultural lands and open spaces, to promote soil and <br /> water conservation, to promote orderly land use planning and <br /> development, and to provide tax relief to owners of farmland <br /> covered by the program. <br /> (3) In order to participate in the farmland preservation <br /> program, a county must adopt an agricultural preservation plan <br /> which is certified by the LWCB. In order to be certified by the <br /> LWCB, a county agricultural preservation plan must comply with <br /> standards specified under subch. IV of ch. 91, Stats . Among other <br /> things, a county agricultural preservation plan must designate <br /> agricultural preservation areas which are to be preserved for <br /> agricultural use . <br /> (4) Under the farmland preservation program, a county, town <br /> or municipality may adopt an exclusive agricultural zoning <br /> ordinance . If the ordinance is certified by the LWCB, owners of <br /> farmland zoned for exclusive agricultural use may claim farmland <br /> preservation tax credits . In order to be certified by the LWCB an <br /> exclusive agricultural zoning ordinance must comply with standards <br /> specified under subch. V of ch. 91, Stats . Under s . 91 . 73 (2) , <br /> Stats . , an exclusive agricultural zoning ordinance must be <br /> consistent with the county' s certified agricultural preservation <br /> plan. <br /> (5) Pursuant to ch. 91, Stats . , and LWCB bylaws, the <br /> department initially reviews all requests for LWCB certification of <br /> agricultural preservation plans and exclusive agricultural zoning <br /> ordinances . The department may ask a requester to provide relevant <br /> information and documentation related to a certification request . <br /> Based on its review, the department prepares a recommendation and <br /> proposed decision for consideration by the LWCB. <br />
