(6) The State of Wisconsin Agricultural Preservation Board <br /> (the predecessor of the LWCB) originally certified the Dane County <br /> Exclusive Agricultural Zoning Ordinance on June 5, 1978 . Dane <br /> County has amended its ordinance at various times since 1978 . <br /> Portions of the current ordinance text are not consistent with ch. <br /> 91, Stats . <br /> (7) On December 20, 1993 , the LWCB considered Dane County' s <br /> request for certification of an ordinance amendment which extended <br /> exclusive agricultural zoning to the Town of Windsor. The Town of <br /> Windsor map amendment complied with ch. 91, Stats . , and was <br /> consistent with Dane County' s agricultural preservation plan. <br /> However, the LWCB noted that the text of the Dane County ordinance <br /> was not fully consistent with ch. 91, Stats . <br /> (8) On December 20, 1993 , the LWCB certified the Dane County <br /> ordinance (including the complete ordinance text and the map <br /> amendment related to the Town of Windsor) on a conditional basis . <br /> The LWCB certified the ordinance only for the year 1993 , subject to <br /> the following conditions : <br /> (a) Dane County would interpret the ordinance text to conform <br /> to ch. 91, Stats . <br /> (b) Dane County would amend its ordinance text to do all of <br /> the following: <br /> 1 . Require conditional use permits for certain land <br /> uses in exclusive agricultural use districts . <br /> 2 . Incorporate the statutory definition of the "use <br /> consistent with agricultural use. " <br /> 3 . Require findings under s . 91 . 77, Stats . , before <br /> rezoning land out of an exclusive agricultural use <br /> district . <br /> (9) On November 29, 1994, the LWCB extended the certification <br /> of the Dane County ordinance for the years 1994 and 1995 only, <br /> subject to the following conditions : <br /> (a) Dane County shall interpret its ordinance in compliance <br /> with ch. 91, Stats . , and applicable rules . <br /> (b) Dane County shall amend its ordinance to do all of the <br /> following: <br /> 1 . Restrict nonagricultural uses in exclusive <br /> agricultural use districts consistent with ch. 91, <br /> Stats . , and applicable rules . <br /> 2 . Require that special exceptions, conditional uses <br /> and variances in exclusive agricultural use <br /> districts be "consistent with agricultural use, " as <br /> required under ch. 91, Stats . , and applicable <br /> rules . <br />
