BACKGROUND <br /> A. Request <br /> David Batker et al,are requesting to rezone 9.8 acres from the A-1(exclusive)district to the <br /> RH-2 and RH-1 districts to create a total of four lots on property in the Town of Verona. The <br /> northern 2.3 acres of this land(Lot 1 on the preliminary CSM)would be attached to 4 acres of <br /> RH-2-zoned land currently owned by Richard Craine. The other three 2.5-acre lots(Lots 2,3 & <br /> 4 on the preliminary CSM)would be zoned RH-1 and are intended for new single family <br /> residences. <br /> B. History/Past Actions <br /> The 9.8 acre A-1(ex)parcel that is the subject of this petition is apparently a legal, <br /> nonconforming parcel that was created before exclusive agricultural zoning was adopted. The <br /> original petition presented to the ZNR Committee at public hearing on 5/26/98 proposed the <br /> creation of two 4.9 acre parcels,both zoned RH-1. There is a 9/23/98 letter(see petition file) <br /> from Richard Craine requesting an amendment to the petition as described above. On October 7, <br /> 1998, after discussions with the applicant and with Mr. Craine,the Verona Town Board voted 4- <br /> 1 to recommend approval of the amended petition. <br /> C. Site/Locational Information <br /> The property is in the northwest quarter of the northeast quarter of section 25, Town of Verona, <br /> on the eastern side of Shady Bend Road. The site is in a rural area, approximately 1.25 miles <br /> southeast of the City of Verona and a third of a mile west of the City of Fitchburg. The site is <br /> currently vacant and heavily wooded. There are no prime farm soils on the site, and the land <br /> does not appear to have been farmed in the past. <br /> Mr. Craine has a home on the property to the north that would become part of proposed Lot 1. <br /> The Shady Bend Subdivision, a 6-lot RH-2 zoned residential development, lies immediately <br /> across Shady Bend Road to the west. There are four RH-1 zoned lots to the south, separated <br /> from the Batker et al property by a roughly 200-foot wide A-1(ex) flag of woodlands. About <br /> seventeen RH-1 lots, all created by CSM, are along Davis Hill Drive on the other side of County <br /> Trunk Highway M to the southwest. About 200 feet of woodlands separate the property from <br /> agricultural fields to the east(see map). <br /> 1 <br />
