DANE COUNTY PLANNING AND DEVELOPMENT DEPARTMENT <br /> STAFF REPORT 7/7/98 <br /> Petition 7252-- Walstad Public Hearing Date: 6/23/98 <br /> I. BACKGROUND <br /> A. Request <br /> Kenneth G. Walstad is seeking to rezone 113 acres from A-1(exclusive) to A-2 on property in <br /> the Town of Blue Mounds in order to separate and sell existing farm buildings from the farm <br /> (Parcel A, 17 acres), and to sell most of the balance of the farm (Parcel B, 72.16 acres). Mr. <br /> Walstad also intends to rezone 23.43 acres (Parcel C) adjacent to his home to keep for his own <br /> use. <br /> B. Site/Locational Information <br /> The property is in the northeast and southeast quarters of Section 33 and the northwest quarter of <br /> Section 34 in the Town of Blue Mounds. Mayflower Road separates Parcel C from the balance <br /> of the property; total frontage equals approximately 1,300 feet on both the north and south sides <br /> of the road. The property is in a rural area, surrounded on all four sides by agricultural <br /> operations. <br /> D. Other approvals required <br /> A Certified Survey Map will be necessary, and if this petition is approved, a delayed effective <br /> date should apply. Mr. Walstad has already submitted a draft CSM showing the two lots smaller <br /> than 35 acres. Since this action will use up all remaining splits under the town land use plan, <br /> deed restrictions on the balance of the property may also be appropriate. Depending on the exact <br /> location of buildings and driveways, an erosion control plan and/or a special exception permit for <br /> grading and filling may also be required. Zoning permits will be necessary before construction <br /> on any building may begin. <br /> II. ANALYSIS <br /> A. Compliance with County Ordinances <br /> The proposed A-2 zoning districts would allow single family residences as permitted uses, and <br /> the proposed lots meet minimum lot size requirements for that district. Shoreland zoning would <br /> apply within 300 feet of the intermittent and perennial streams, unless field investigation shows <br /> the streams not to be navigable. This would require a minimum building setback of 75 feet from <br /> the ordinary highwater mark of the stream, limits on vegetation removal within 35 feet of the <br /> stream and special exception permits for any filling or grading within 300 feet of the stream. <br /> Note that if the surrounding land is converted from agricultural use, any exemptions from <br /> shoreland standards for agricultural drainages would no longer apply. <br /> B. Compliance with Adopted Plans <br /> As proposed, the petition would rezone the entire 113 acre farm out of the A-1(exclusive) zoning <br /> district. This would seem to conflict with the Town of Blue Mounds (adopted in 1980) land use <br /> plan, which lists a number of criteria(see RPC staff comments in Composite Report) designed to <br /> 1 <br />
