DECLARATION OF ZONING AND USE RESTRICTIONS <br /> WHEREAS, James P.Noltner and Gayle Ann M.Noltner, <br /> husband and wife, (hereinafter referred to as "Owners") are <br /> the owners of a certain parcel of real estate described as: <br /> Section 20, Town 7 North, Range 8 East(Township of Middleton), Part of the Northwest <br /> 1/4 of the Southeast 1/4: Commencing at the section's east 1/4 corner; thence south 89 <br /> degrees west, 2060 feet to POB;thence south 1 degree west, 1300 feet; thence south 89 <br /> degrees west, 579.61 feet;thence north 1 degree 3 minutes east, 1300 feet;thence north <br /> 89 degrees east, 579.61 feet,to POB. Containing 16.31 Acres excluding road right-of- <br /> way. (From Tax Data) <br /> Tax Parcel No: 19-0708-204-8570-9 <br /> WHEREAS, Owners wish to rezone a portion of said parcel according to the attached <br /> survey map and description in order to allow for limited commercial use of certain of the existing <br /> buildings; and, <br /> WHEREAS,the Town of Middleton and Dane County will approve the proposed <br /> rezoning conditioned upon the imposition of certain restrictions on the permitted uses of the <br /> property shown in the attached survey map; and, <br /> WHEREAS, Owners desire To place certain restrictions thereon,to bind the Owners and <br /> those who may acquire title hereafter; <br /> NOW,THEREFORE, in consideration of the Town of Middleton and Dane County <br /> conditionally approving the rezoning of the property as noted in the attached survey and the <br /> mutual benefits passing to and from the Owners and those who may hereafter purchase said land <br /> and the parties named as beneficiaries of these restrictions, Owners hereby agree that the <br /> following restrictions are hereby imposed and the permitted use of the property shall be limited <br /> as provided in this declaration. <br /> A. Permitted Use of the Property. <br /> 1.Notwithstanding the A1-Agricultural zoning which applies to a portion of said <br /> property, Owners agree that no agricultural uses shall be permitted, including, but not <br /> limited to, any type of animal husbandry, except the raising of crops for feed or grain and <br /> the raising of flowers, fruits,vegetables, trees and shrubs for use by the Owners or <br /> residents or for incidental sale shall be permitted. <br /> 2. The raising of domesticated pets shall be permitted, except there shall be no raising of <br /> any cattle, swine or sheep as pets,nor any species of animal for purposes of selling meat, <br /> milk, fleece or breeding stock. <br /> 1 <br />
