COMPOSITE REPORT- Application No. CUP 1466 <br /> Public Hearing 11/29/97 Town of Oregon <br /> F. The proposed use is compatible with the use of the adjacent Brooklyn Wildlife <br /> Area as a nature preserve. The proposal is to preserve and not disturb surrounding <br /> wetlands, and to leave a majority of the property as a wildlife preserve. Most of the <br /> wooded areas of the property and the wetlands will remain an enclave to enjoy the rural <br /> character of the area. The only potential problem, addressed bellow, would be the <br /> compatibility with the hunting occurring in the DNR preserve during five months a year. <br /> G. The use of the adjacent DNR property for hunting is not incompatible with the <br /> proposed use. The concern could be from September 13 when the season opens for <br /> Gray and Fox Squirrel on to February 15 for Red and Gray Fox on February 15, and <br /> mostly during the nine days per year of Deer Hunting season(with shotguns). In terms <br /> of noise, the need for insulating and heating the building during the hunting season will <br /> eliminate the potential noise disruption to retreat activities. In terms of safety, if the <br /> property limits are clearly marked -the property is fenced with barbed wire-, the hunters <br /> will not trespass the property and by knowing where the limits of the DNR property are, <br /> should not shoot into it. In the case they did, the building is more than 100 yards from <br /> the property line which is over the shooting range of a shotgun with deerslugs. Safety <br /> would be a concern if the use proposed was encouraging the presence of children in the <br /> property such as a proposal for a day care facility or a residence. <br /> H. The proposal complies with standards H and I for CUPs in Al-EX areas: it does not <br /> place an unreasonable burden on the local unit of government. No children will be <br /> added to the school district and the increase of traffic will be, as an average, equivalent <br /> to the traffic created by one additional family in the area on average. <br /> The driveway needs to be upgraded. It is of a similar quality with the majority of <br /> driveways to rural homes and farms in the area. According to the Town Plan (page 33): <br /> "All driveways should be reviewed and jointly approved by the Oregon Area Fire <br /> Department, Town Engineer and the Town in order to ensure safe and adequate access <br /> to and from the site. ... . Driveways must be constructed prior to commencing <br /> construction on any development activities." <br /> The proposed driveway was reviewed by the town engineer who specified in a follow-up <br /> letter dated November 10, 1997 all the improvements. According to the Town <br /> Engineer, the proposed driveway appears to be adequate emergency vehicle access and <br /> occupant access. There is no letter from the Oregon Area Fire Department. <br /> J. The Proposal follows the six conditions for granting a CUP in S. 10.255(2)(h): <br /> a) That the conditional use will not endanger the public health, safety, <br /> and welfare. <br /> b) That uses, values, and enjoyment of other properties in the <br /> neighborhood will not be impaired by the conditional use. <br /> c) That the conditional use will not impede orderly development of <br /> surrounding property. <br />
