g.) Only land that is comprised of soils that are suitable for on-site septic system, <br /> shall be considered for redesignation in this Category. Documentation from <br /> Dane County Environmental Health signed by a sanitarian showing that a <br /> conventional septic or mound system permit is available and has been approved <br /> for the proposed site shall be required prior to rezoning. <br /> 4 <br /> h). Provision of public facilities to accommodate the proposed development will not <br /> place an unreasonable burden on the ability of the Town of Oregon to provided <br /> those facilities. The petitioner must demonstrate to the Town that the current <br /> levels of services in the Town (including but not limited to school capacity, <br /> transportation system capacity, emergency services(police, fire, EMS)capacity, <br /> parks and open space availability, etc.) are adequate to serve the proposed use. <br /> The land proposed for redesignation is suitable for development and will not <br /> result in undue water or air pollution, cause unreasonable soil erosion or have <br /> an unreasonably adverse effect on rare or irreplaceable natural areas (such as <br /> floodplains, wetlands, steep slopes, significant woodlands, etc.). <br /> 4. ligtgposedzwellings and accessory buildings on lands in the Agricultural Preservation <br /> Area Category"that are zoned A-1 Exclusive Agriculture may not be located on land <br /> devoted primarily to agricultural uses. The following factors will be used by the Town <br /> and the County Zoning and Natural Resources Committee to determine the location of <br /> dwellings and accessory buildings on A-1 Exclusive Agriculture zoned parcels in the <br /> Agricultural Preservation Area Category: <br /> • <br /> `a). There will be no more than a minimal encroachment into existing or potential <br /> cropland. <br /> b). There will be no more than a minimum of cropland used for the driveway. <br /> `) The remaining site has enough crop yield potential to be e viable for agricultural <br /> d). There is adequate access to the site to accommodate necessary agricultural <br /> equipment. <br /> The slope of the site is appropriate for agricultural uses without being subject <br /> to erosion problems. <br /> f). The project will cause no more than a minimum of land disturbance on the <br /> entire property. <br /> g)• There are no other sites on the property that could be reasonably utilized for <br /> construction of a building. <br /> 5. 7'N-6n-farm related commercial and industrial uses shall not be permitted in this Category. .- <br /> Such uses shall only be considered for approval on parcels located in the mapped Rural <br /> Commercial-Industrial Overlay Category as depicted on the Town's Land Use Plan Map <br /> Only commercial uses clearly and principally related to agricultural production shall be <br /> considered for approval in the Agricultural Preservation Area Category. <br /> 22 <br />
