Owner has petitioned to rezone the Property to C-2 Commercial District <br /> pursuant to the Dane County Code of Ordinances. The Owner intends to subdivide the <br /> Property into lots; however, the number and composition of such lots is presently <br /> unknown. <br /> C. Owner wishes to place certain restrictions, conditions, covenants and <br /> reservations on the Property to bind Owner and those who may acquire title hereafter. <br /> NOW, THEREFORE, in consideration of the mutual benefits passing to and from <br /> Owner and those who may hereafter acquire title to all or any part of the Property, Owner <br /> declares as follows: <br /> 1. Allowed Uses (Zoning Restrictions). Ownership and use of the Property <br /> shall be limited to all uses permitted in the C-1 and C-2 Commercial Districts as specified <br /> in sections 10.13 and 10.14 of the Dane County Zoning Code as of October 1, 1995, a <br /> copy of which is attached hereto as and made a part hereof as Exhibit B, except for the <br /> following uses which shall be prohibited: <br /> (a) Rooming and boarding houses; <br /> (b) Marinas; <br /> (c) Single family residences, duplexes, and multi-family residences; <br /> (d) Mobile home parks; <br /> (e) Outdoor movie theaters; <br /> (f) Dog and cat boarding kennels, grooming and training facilities; <br /> (g) Radio and television transmitting towers, microwave towers, and <br /> community television antenna, although a water tower shall be permitted; <br /> (h) Sales of new and used mobile homes, recreational equipment, and <br /> related rental, sales and service; <br /> (i) Bulk fuel storage and sales; <br /> (j) Auxiliary or supplemental electric generating stations; <br /> (k) Fertilizer mixing or blending plants; <br /> (1) Slaughter houses, meat processing plants; <br /> (m) Storage, maintenance and repair of carnival, concession and circus <br /> machinery and equipment; <br /> (n) Automobile race tracks, motorcycle race tracks, including moto-cross <br /> and hill climbing courses; <br /> (o) Mineral extraction; <br /> H:\W I P\8006\86\RESTCOV3.MPD <br /> 0115980920 2 <br />
