(p) Solid waste disposal operations, sanitary landfill sites; and, <br /> (q) Taverns. <br /> 2. Conditional Uses. The following uses of the Property shall be prohibited <br /> unless a permit for such use as a conditional use is issued pursuant to the procedures and <br /> standards in place to grant such conditional use permits under the appropriate local zoning <br /> code: <br /> (a) Games such as horseshoes, volleyball or similar activities not lighted <br /> for night operation, or lighted to operate at night; <br /> (b) Sales of new and used contractor's machinery and equipment; <br /> (c) Repairs, storage and service of contractor's machinery and equipment; <br /> (d) Rental and leasing of motor vehicles, contractor's machinery and <br /> equipment; and <br /> (e) Automobile and truck driver training schools and construction <br /> equipment operator training schools that are privately owned and operated for <br /> profit. <br /> 3. Traffic Use. Commercial trucks shall be allowed to use Kennedy Drive to <br /> access the Kennedy Trust property (Portion 2, above). Commercial trucks shall be <br /> encouraged not to use Kennedy Drive to access the GJH Group, LLC Property (Portion 1, <br /> above), and attempts shall be made to limit such trucks to the use of River Road. <br /> Employees and patrons of businesses located on the Property may use Kennedy Drive. <br /> However, no commercial truck traffic serving the Property will be allowed west of the <br /> railroad tracks on Kennedy Drive, or to access the Property from the west on Kennedy <br /> Drive. <br /> 4. Enforcement. The restrictions provided for herein shall be enforceable at <br /> law or equity against any party who has, or acquires, an interest in the Property subject <br /> to the restrictions, by any of the following parties who are hereby named as grantees, <br /> promisees, and beneficiaries with enforcement rights hereunder: <br /> (a) The county government of Dane County, Wisconsin provided that the <br /> Property is under the jurisdiction of zoning ordinances of Dane County at the time <br /> the enforcement action is commenced; and, <br /> (b) The town government of the Town of Westport, Dane County, <br /> Wisconsin, provided that Property is within the governmental jurisdiction of said <br /> town at the time the enforcement action is commenced; and, <br /> (c) The owner(s) of record who hereafter acquire all or a portion of the <br /> Property. <br /> H:\W IP\8006\86\RESTCOV 3.MPD <br /> 0115980920 3 <br />
