However, the building for which the Conditional Use Permit was approved by the Zoning and <br /> Natural Resources Committee somehow became a wood working shop, a residential rental <br /> property, a pottery shop and a beauty salon. The building has been extensively remodeled and <br /> contains a bath and shower facility on the first floor, a shampoo sink in the beauty salon, a sink <br /> on the second floor, a gas fired furnace, an electric water heater, a wood burning stove and <br /> connection to a septic system serving the residence on this property among other improvements. <br /> "Staff Comments" received by the Committee regarding CUP 1462 included the following <br /> comments from Environmental Health: <br /> There is no information in our file regarding the age, size or construction of the existing <br /> private sewage system. The proposed business is considered an increase in wastewater <br /> discharge to the existing system. A review of the existing system as required by <br /> Wisconsin Administrative Code Comm 83.055 should be required before the zoning <br /> change is approved. <br /> The minutes of the Zoning and Natural Resources Committee of January 6, 1998, contain the <br /> following: <br /> Motion by Cornwell/Kesterson to postpone until such time that an inspection of the <br /> private septic system is conducted and the submittal of other pertinent information. <br /> We are unaware that any inspection of the private septic system has been completed. In fact, <br /> the Town of Middleton sent an inquiry to the property owners dated January 7, 1998 (see <br /> Attachment C). To date, we have not received a response from the property owners. <br /> The Town of Middleton Building Inspector attempted to arrange an inspection of the property <br /> at 4123 Twin Valley Road beginning in early January of 1998. The owners consistently refused <br /> to allow the inspection to be completed. <br /> On June 23, 1998, the Town's Building Inspector(Rob Allen),the Town's Plumbing <br /> Inspector(Art Stark), and two inspectors from the Middleton Fire Department conducted an <br /> inspection of the property. The violations and remediations required as identified by the <br /> inspectors are numerous and in many cases will require the removal of existing portions of the <br /> structure. <br /> A primary concern regarding the septic system continues to exist. The property owner <br /> indicated that the connection from the garage to the septic system is "to the discharge side of the <br /> septic tank." Such a connection is a serious violation of the State Plumbing Code. The Town <br /> Plumbing Inspector indicated that a "private system interceptor main" may he required to correct <br /> the situation. provided the system could accommodate the increased use. <br />
