The Town of <br /> Middleton Board of Supervisors rejected the CUP petition on December 1, 1997 (see Attachment <br /> A). <br /> Ms. Kane has appeared at several meetings of the Zoning and Natural Resources Committee <br /> in support of the CUP petition, including the meeting of January 6, 1998. Unfortunately, the <br /> information provided to the ZNR Committee by Ms.Kane is,in many instances, erroneous and <br /> inaccurate.It also appears that Ms. Kane may be attempting to mislead the Committee based on <br /> certain information provided. <br /> For example, on January 6, 1998, Ms. Kane presented the ZNR Committee a letter requesting <br /> approval of the CUP petition (see Attachment B). The letter included the following statement: <br /> "Any misconceptions regarding our request have been largely due to the <br /> misrepresentation of our request as Commercial Rezoning endeavor. We believe this <br /> confusion between Rezoning and limited family business--C.U.P.—has prevented us <br /> from gaining the full support of the Middleton Town Board." <br /> The comment contained in the January 6, 1998, letter to the ZNR Committee from the Kane's <br /> is not correct. The Town of Middleton Board of Supervisors was fully cognizant that the petition <br /> requested a Conditional Use Permit and not a rezoning. In fact, as Town Administrator, I <br /> prepared and submitted to the Town Board a memorandum dated November 5, 1997, which <br /> clearly stated the purpose of the CUP petition (see Attachment C). I would note that a copy of <br /> this memorandum was provided to the Kanes. <br /> 1 <br />
