In addition, I would call ZNR Committee's attention to the November 5, 1997, minutes of the <br /> Town of Middleton Plan Commission: <br /> 5.LORI KANE - CONDITIONAL USE PERMIT <br /> Ms.Kane appeared before the Commission regarding her petition for a Conditional Use <br /> Permit(CUP)for a Limited Family Business on Twin Valley Road. The Administrator <br /> distributed a memorandum regarding the request and improvements which have been <br /> made to the property without appropriate permits (see Attachment B). The Administrator <br /> also noted that several of the neighbors had contacted the Town in opposition to the <br /> request. The Administrator also noted that the Town's role in CUP requests is advisory <br /> only. <br /> During discussion, Ms. Kane noted the following: <br /> 1)Permits had been obtained for the original construction of the accessory building. The <br /> Town Administrator requested that Ms. Kane forward any information or documents <br /> which may be in her possession regarding such permits. <br /> 2)Ms. Kane's spouse is a woodcraft artist who also has a business on the property. <br /> ■•c <br /> 3)At times, Mr. Kane has'°allowed others to utilize his woodcraft shop for production and <br /> business purposes. <br /> 4)Ms. Kane was formerly leasing space in Madison but relocated her business to the <br /> accessory building on their property. <br /> Chairman Wilson noted that the request appeared to meet the County requirements. In <br /> addition,the Chairman noted that the CUP lapses when the property is sold or <br /> transferred. <br /> Following discussion,Member Acker moved, seconded by Member Kolar to recommend <br /> approval of the Conditional Use Permit provided that 1)satisfactory negotiations were <br /> concluded with the Kanes adjacent property addressing concerns which they may have; 2) <br /> compliance with all Town ordinances and Fire Department requirements; and, 3) subject <br /> to an inspection of the property by Members Acker and Breunig to verify the applicability <br /> of the CUP provisions. <br /> MOTION CARRIED. <br /> 2 <br />
