I would also call the Committee's attention to the Town Board minutes of November 17, <br /> 1997: <br /> 9. 8:15 PM -PUBLIC HEARING -DAVID AND LORI KANE REQUEST FOR <br /> CONDITIONAL USE PERMIT <br /> Supervisor Mueller moved, seconded by Supervisor Bakken,to open the Public <br /> Hearing at 8:35 PM. <br /> MOTION CARRIED. <br /> Lori Kane appeared before the Board and explained that the request is for a CUP for a <br /> limited family business, a beauty salon. Kane indicated that the salon would be in <br /> operation for 20-25 hours per week. Kane also indicated that she anticipates one vehicle <br /> per hour. <br /> Several adjoining property owners appeared in opposition to the CUP request. Frank <br /> Church presented a written objection (see Attachment D). Other residents registering <br /> opposition included Betty French, Wayne Rounds, Jr.,Ed Hilgendorf and Sharon <br /> Maoloney. The Administrator also indicated that he had received a written objection from <br /> David Manion and Jan Manser of 4168 Twin Valley Road(see Attachment E). <br /> During discussion, Ms. Kanegconfirmed that her spouse is also operating a woodworking <br /> and art business from the name building. In addition,Ms. Kane confirmed that other <br /> individuals had been allowed to operate a woodworking business at the site and an <br /> individual(s)had been allowed to reside in the accessory building. The Administrator <br /> noted that the Plan Commission had directed the Kanes to meet with neighbors to discuss <br /> appropriate restrictions and conditions; however, such discussions apparently never <br /> occurred. <br /> Supervisor Bakken moved, seconded by Supervisor Mueller,to close the Public Hearing <br /> at 9:05 PM. <br /> MOTION CARRIED. <br /> Supervisor Mueller moved, seconded by Supervisor Riker, to table the CUP request until <br /> December 1, 1997, to allow the Kanes and their neighbors to attempt to agree to on <br /> appropriate conditions. <br /> MOTION CARRIED. <br /> Clearly, Town officials and policy makers were well informed that the Kane request <br /> reflected a Conditional Use Permit. <br /> 3 <br />
