-Maximum permitted height of accessory building is 16 feet. <br /> NOTE: The second story area of the accessory building appears to have a <br /> roof line of 22-24 feet. The first floor has a roof line of 14-16 feet. The Town <br /> has been unable to verify the actual height since the Kanes have not agreed <br /> to allow the Town Building Inspector on site. It may be necessary to seek an <br /> inspection warrant to gain access. I would note that the Assessor informs me <br /> that the Kanes have also denied him access to the property. <br /> -This building shall be used for storage of personal property incidental to a <br /> residential use and shall not be used for any business or commercial purpose or <br /> human habitation. <br /> NOTE: The Assessor's notes from 1993, as shown in Attachment E,indicate <br /> that the accessory building or garage was being used for residential <br /> purposes. In addition, the building has been used for business and <br /> commercial purposes for several years according to Ms.Kane's statements to <br /> the Plan Commission and the Town Board. <br /> -Owner and agent hereby agree to comply with all Dane County Ordinances. Any <br /> unauthorized change from the information or plans submitted will invalidate the <br /> permit. <br /> ity <br /> NOTE: There isrfo record that the Kanes ever applied for or received either <br /> Zoning Permit(s) from Dane County or building permit(s) from the Town of <br /> Middleton regarding the remodeling of the second story to residential use or <br /> the first floor to a beauty parlor. Such use invalidates the Zoning permit <br /> issued in 1991. <br /> As noted in Attachment D, Dane County Zoning Department issued a"Certificate of <br /> Compliance"dated August 5, 1991. The Certificate of Compliance indicates the construction of a <br /> "Det. Res. Garage"and contains the following notation: <br /> "This building is not to be used for business or commercial purposes or human <br /> habitation." <br /> The Certificate of Compliance was signed by Patrick Anderson, Zoning Administrator. <br /> 5 <br />
