Supervisor Held: Important to distinguish between rezoning and CUP. Unfortunate that conditions could not be agreed upon between neighbors. However, in instances such as this,must place priority on the position of neighbors who oppose CUP. Supervisor Bakken: Concurs with the statements of Supervisor Held. Hopes that the Board will provide some time to relocate business. Supervisor Mueller: Concerned about ambiguities and application of Dane County Zoning Code. Intends to vote against the motion. Supervisor Bakken moved,seconded by Supervisor Held,to amend the motion to disapprove the CUP to provide a grace period of 90 days from date of denial by Dane County to relocate the business. MOTION CARRIED. The Chairman called the question on the motion as amended. MOTION CARRIED. (3-1-1 Bakken abstained,Mueller voted no) I have also included the minutegrom the Public Hearing regarding the Kane's request for a Conditional Use Permit which 0,1413 held at the Town of Middleton on November 17, 1997. 9. 8:15 PM- PUBLIC HEARING-DAVID AND LORI KANE REQUEST FOR CONDITIONAL USE PERMIT Supervisor Mueller moved, seconded by Supervisor Bakken, to open the Public Hearing at 8:35 PM. MOTION CARRIED. Lori Kane appeared before the Board and explained that the request is for a CUP for a limited family business, a beauty salon. Kane indicated that the salon would be in operation for 20 - 25 hours per week. Kane also indicated that she anticipates one vehicle per hour. Several adjoining property owners appeared in opposition to the CUP request. Frank Church presented a written objection (see Attachment D). Other residents registering opposition included Betty French, Wayne Rounds, Jr.,Ed Hilgendorf and Sharon Maoloney. The Administrator also indicated that he had received a written objection from David Manion and Jan Manser of 4168 Twin Valley Road (see Attachment E). 2
