Supervisor Held: Important to distinguish between rezoning and CUP. Unfortunate <br /> that conditions could not be agreed upon between neighbors. <br /> However, in instances such as this,must place priority on the <br /> position of neighbors who oppose CUP. <br /> Supervisor Bakken: Concurs with the statements of Supervisor Held. Hopes that the <br /> Board will provide some time to relocate business. <br /> Supervisor Mueller: Concerned about ambiguities and application of Dane County <br /> Zoning Code. Intends to vote against the motion. <br /> Supervisor Bakken moved,seconded by Supervisor Held,to amend the motion to disapprove <br /> the CUP to provide a grace period of 90 days from date of denial by Dane County to relocate the <br /> business. <br /> MOTION CARRIED. <br /> The Chairman called the question on the motion as amended. <br /> MOTION CARRIED. (3-1-1 Bakken abstained,Mueller voted no) <br /> I have also included the minutegrom the Public Hearing regarding the Kane's request for a <br /> Conditional Use Permit which 0,1413 held at the Town of Middleton on November 17, 1997. <br /> 9. 8:15 PM- PUBLIC HEARING-DAVID AND LORI KANE REQUEST FOR <br /> CONDITIONAL USE PERMIT <br /> Supervisor Mueller moved, seconded by Supervisor Bakken, to open the Public Hearing at <br /> 8:35 PM. <br /> MOTION CARRIED. <br /> Lori Kane appeared before the Board and explained that the request is for a CUP for a limited <br /> family business, a beauty salon. Kane indicated that the salon would be in operation for 20 - 25 <br /> hours per week. Kane also indicated that she anticipates one vehicle per hour. <br /> Several adjoining property owners appeared in opposition to the CUP request. Frank Church <br /> presented a written objection (see Attachment D). Other residents registering opposition included <br /> Betty French, Wayne Rounds, Jr.,Ed Hilgendorf and Sharon Maoloney. The Administrator also <br /> indicated that he had received a written objection from David Manion and Jan Manser of 4168 <br /> Twin Valley Road (see Attachment E). <br /> 2 <br />
