The Vienna Plan Commission review the petition at their <br /> Plan Commission meeting on August 18, 1997 and recommended approval with <br /> conditions and restrictions. <br /> H-1 . i i)( <br /> The plan committee approved and recommended that t e 2 portion of the property be <br /> conditioned and restricted to only the permitted use(f)"Repairs, storage and service of <br /> contractor's machinery and equipment" from the C-2 Commercial District. Such <br /> restriction and condition would exclude all other allowable uses and conditional uses <br /> including those allowed in the C-1 District. The plan committee further recommended <br /> that conditions and restrictions he place on the remainder of the parcel zoned A-2. which <br /> would allow only permitted uses: (a) Agricultural uses. (h) Single family detached <br /> residences. (c) Utility services. (d) l tome occupations as defined ins. 10.01 (25), and <br /> (e) Accessory buildings. and conditions I & 2 for accessory building. All other uses <br /> including those listed as conditional uses would deed restricted and not allowed. <br /> The Vienna Town Board held a public hearing on Payne& Dolan Zoning Petition <br /> request # 7040 on September 8, 1997. The Vienna Town Board reviewed and <br /> recommended approval of Zoning Petition # 7040 as requested by Payne & Dolan by a <br /> vote of three in favor and none opposed with the recording of conditions and restrictions <br /> stated above and approved by the Town Plan Commission at their meeting on August 18, <br /> 1997. The Town Board also noted that the requested zoning change would require a <br /> variance from the Town of Vienna Plan to secure approval. The Town of Vienna Board <br /> and Plan Commission recommends that such variance he granted for the following <br /> reasons: <br /> 1) The Payne & Dolan property for which the zoning change and variance are requested <br /> is located in section 22 of the Town of Vienna and is surrounded by properties on <br /> all sides with uses which would not be in conflicted with the requested use. The <br /> property was formerly used as the site for a hot mix plant and quarry operation by <br />
