COMPOSITE REPORT - Page 2 APPLICATION NO. <br /> STAFF COMMENTS <br /> REGIONAL PLANNING <br /> Petition 7109. This proposed four-parcel residential area raises policy concerns with the <br /> adopted town/county plan in the Town of Berry. <br /> The site is half woodland and half pasture located north of Indian Lake County Park. <br /> The relevant policies for this proposal are: <br /> "No land division of less than 35 acres will be permitted in the agricultural district <br /> unless the following criteria are all met as follows: <br /> - Land where farming has not been economical in the past <br /> - Land parcels too small for practical agriculture activities such as <br /> accessibility for farm machinery <br /> - Land which does not require the development of a public road, and <br /> fronts or abuts a public road <br /> - Land which has less productive soils than "prime"or "Statewide <br /> significance"as delineated on the soil maps <br /> - Land where development would not destroy wetlands, and steep <br /> slopes. <br /> There will be a limit to the number of lots which may be created by certified <br /> survey of one parcel for each thirty-five acres, or portion thereof, owned as of the <br /> date of the adoption of this plan." <br /> Comments related to the policies: <br /> - The application indicates the site is half pasture and half woodland. <br /> - Size of the parcel is not an issue, but there are steep slopes which limit the <br /> usefulness for farming. <br /> - The only usable access to this site is a farm entrance off STH 19 at the southeast <br /> corner of the site. All of the other frontage along STH 19 to the south has a very <br /> steep, stoney hill face. An easement from this existing access point is proposed <br /> to serve the four residential parcels. <br /> Because the proposed parcels are more than 15 acres in size, there is not a <br /> specific requirement for direct access to a public road. However, the plan policy <br /> requires parcels to "front or abut a public road." <br /> Thus there is a situation where the plan opposes creation of a public road, but the <br /> configuration proposed appears to require the residential parcels "front or abut a <br /> public road." This policy conflict needs to be resolved prior to approval of this <br /> rezoning. <br /> - The land is definitely less productive as farmland. <br />
