COMPOSITE REPORT - Page 4 Application No. 7109 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> I. BACKGROUND <br /> A. The applicant is requesting rezoning of a total of 66 acres from A-1 Exclusive to A-2 to <br /> allow residential development of four lots. <br /> B. The subject property is in the Town of Berry,north of Indian Lake. <br /> C. The property is roughly five and a quarter miles north of the Village of Cross Plains. It is <br /> not within an urban service area. All four lots are larger than 15 acres, so a Certified <br /> Survey Map is not required. <br /> II. ANALYSIS <br /> A. The property is located in the preferred corridor for the Ice Age Trail, as identified in the <br /> Dane County Parks and Open Space Plan. See comments from the Parks Department, <br /> attached. The proposed land division is inconsistent with the Town of Land Use Plan, <br /> which recommends land divisions of less than 35 acres in an agriculture protection area to <br /> front or abut onto a public road. The applicant seeks to create two lots of 16 and 18 acres <br /> that do not abut onto a public road. A third lot, although abutting Highway 19, would <br /> probably require alternative access due to the steep slopes in that section of the property. <br /> The applicant intends to provide access by a privately-owned common driveway that <br /> would follow the same route as an existing field road. <br /> B. Dane County Regional Planning Commission staff have expressed concerns that <br /> development on the bluffs on the southeast portion of the property could lead to erosion <br /> problems and sedimentation of wetlands on the Indian Lake shore. This may be <br /> inconsistent with the Town Plan, which prohibits development that would destroy <br /> wetlands or steep slopes. <br /> C. As of the time of this writing, there is no record of town action on this request. The <br /> property abuts on State Highway 19. Planning and Development staff have contacted the <br /> Wisconsin Department of Transportation but have not yet received comments. <br /> III. SUMMARY <br /> A. If approved, the proposal as petitioned would rezone approximately 66 acres for single <br /> family residential development. The applicant intends to divide four lots from that <br /> property. The proposal would appear to be inconsistent with the town plan, in that it <br /> would create lots that do not abut on a public road, and because of possible indirect <br /> impacts on wetlands and steep slopes. <br /> B. The Zoning and Natural Resources Committee may wish to consider conditions requiring <br /> that the private driveway be constructed and maintained to meet accepted engineering <br /> standards, and to permit access by emergency, delivery or utility vehicles. The Committee <br /> may also wish to consider restricting development to relatively level areas of the property <br />
