• <br /> RESTRICTIONS /PAGE 2 <br /> recreational uses consistent with the woodland character of said lands, including, <br /> without limitation, hiking and horseback riding trails. <br /> C. No structure shall be constructed whose height is such that any portion of that <br /> structure would extend above an imaginary line running from a point six(6) feet <br /> above the top surface of a concrete pad at the base of a green monument sign <br /> reading "Indian Lake" located near the southwest corner of the main parking lot at <br /> Indian Lake County Park on a straight line extending to the treetop horizon at the <br /> location of the structure. The intent of this restriction is to limit the height of <br /> structures so that those structures do not stand above the brow of the wooded <br /> hillside on which the lots are located when viewed from the sign at the County <br /> Park. <br /> D. The colors of the exterior surfaces of all structures constructed upon any of the <br /> lots herein created shall be limited to natural earth tones in the brown, green, <br /> umber or grey families of colors. <br /> E. Conifer or other plant material screens shall be planted to the west side of any <br /> structure constructed on lots One (1) and Two (2), and to the south side of any <br /> structure constructed on Lot Four(4). The intent of this covenant is to soften the _ — <br /> visual impact of such structures, not to totally screen them from view. This <br /> condition shall be satisfied by the planting of trees or shrubs of not less than five <br /> (5) feet in height, on the date of planting, at an interval of no less than one plant <br /> every twelve (12) feet for the length of each structure requiring screening. <br /> These restrictions shall constitute covenants running with the land and shall be binding <br /> upon all parties now owning any part of said land, their successors, heirs and assigns, and all <br /> parties holding under them unless,pursuant to paragraphs 5 or 6 of this instrument, said <br /> restrictions are amended or terminated. <br /> IV The restrictions provided for herein shall be enforceable at law or equity against any party <br /> who has or acquires an interest in the land subject to the restriction by the following <br /> parties who are named as grantees,promisees and beneficiaries with enforcement rights: <br /> (A) The County Government of Dane County, Wisconsin provided that the lands are <br /> under the jurisdiction of zoning ordinance of said County at the time the <br /> enforcement action is commenced; and <br /> (B) The Town Government of the Town of Berry, Dane County, Wisconsin, provided <br /> that the lands are within the governmental jurisdiction of said Town at the time <br /> the enforcement action is commenced. <br />
