Below are one modified condition and two
new conditions that the committee may wish to consider in addition to those included in my earlier memo:
Change Condition 4 to read:
4. No more than 64 mobile home units shall be located on the property.
Add two new conditions:
8. The condominium units numbered 1 through 36 on the Summer Place on the Lake Condominium
Plat shall be deed restricted to permanently remain in open space or natural area use. Any legally
permitted structures on these units, as of the date of this action, shall be treated as nonconforming
structures in accordance with Section 10.23 of the Dane County Zoning Ordinance.
9. Remaining land owned by Fish Lake Development Corporation, including the entire northwest
quarter of the southwest quarter of Section 2, Town of Roxbury and Parcels Numbered 18001,
18530 and 19501 in Section 3, Town of Roxbury shall be deed restricted to non-structural use.
If adopted, these conditions would fully address the concerns about the uncertain ordinary highwater mark
of Fish Lake, and would also lessen the impact of the proposed development on water quality, fish and
wildlife habitat and natural scenic beauty.
Please let me know if I can be of any further assistance.
