LAW OFFICE OF
BRUCE K. KAUFMANN
122 West Mifflin Street
Madison, Wisconsin 53703
608-257-2125
Fax:608-257-0451
February 10, 1998
Mr. James Gregorius
Zoning Administration Dane County
210 Martin Luther Icing Jr., Blvd.
Madison, Wisconsin 53701
RE: Petition #7134
Dear Mr. Gregorius:
Please be advised that I, along with Attorney J. Timothy Lovett, represent David
Atwell, Inc. regarding Petition #7134.
Said Petition is currently before the County ZNR Committee with the request that
the attached restriction be a condition to approval by the ZNR Committee.
As you are aware from a prior ZNR Committee meeting of January 27, the Town of
Cross Plains supervisors support the petition but oppose a deed restriction giving
enforcement power to the County.
Hence, we would first request that no restriction be placed upon the Petition #7134,
however, given the prior discussion at the ZNR Committee meeting of January 27,
1998, it appears that this will not occur.
Thus, given the "Quagmire" caused by the Town's opposition on the enforcement
issue and the ZNR Committees' prior position, on the same issue, our client must
reluctantly agree to the restriction in the format requested by the ZNR Committee.
(See Attachment "A".)
Sincerely,
cc -i 'Ii ..,
Bruce K. Kaufmann
Attorney for David Atwell, Inc.
BI K:jmz
