• Minutes of ZNR Committee March 17 98 Page 2 <br /> Motion by Hendrick/Kesterson to impose the following conditions: <br /> 1. The Town of Blooming Grove and J&H of Wisconsin,Inc. shall execute an agreement regarding <br /> the conditions and requirements of the clay extraction,in a form approved by the Town Attorney. <br /> The operator shall provide a copy of that signed agreement to the County Zoning Administrator. <br /> 2. The operator shall submit to Dane County an erosion control plan covering the CUP area for the <br /> duration of operations,and receive approval of an erosion control permit prior to commencing <br /> extraction operations in Areas 3 and 4 on the site plan. <br /> 3. The operator shall develop and operate the site according to the site and operation plan received <br /> 2/26/98. <br /> 4. All operations shall cease and the entire site shall be reclaimed by December 7,2001,according to <br /> the Reclamation Plan received 2/26/98. Extraction of materials in Area 4 shall not begin until Area <br /> 3 is reclaimed. <br /> 5. Trucks shall access the site from the designated service road only. All drive aisles shall be <br /> maintained in a dust free manner in accordance with local,state,and federal regulations. <br /> 6. The site shall be signed"no trespassing." When the extraction site is not open,the access road shall <br /> have gates securely locked. <br /> 7. Hours of operation shall be from 7:00 a.m.to 4:30 p.m.,Monday through Friday,unless otherwise <br /> provided through the agreement between the operator and the town. <br /> 8. There shall be no blasting or drilling on the site. <br /> 9. There shall be no bulk fuel stored on the site. <br /> 10. No water shall be removed from the site in order to maintain groundwater discharge to adjacent <br /> areas. <br /> 11. The operator shall spray the site with water if and when needed to control dust. <br /> 12. The operator shall require all trucks,excavation,and other equipment to have muffler systems <br /> which meet or exceed then current industry standards for noise abatement. <br /> 13. The applicant shall meet DNR standards for particulate emissions as described in NR 415.075 and <br /> 415.076,Wis.Adm.Code. <br /> 14. J&H of Wisconsin,Inc. shall provide a surety bond or other mutually acceptable fmancial assurance <br /> to the City of Madison to ensure maintenance of,and any required repair to,Sprecher Road and the <br /> unnamed service road resulting from the frequency of travel and normal hauling weights on said <br /> roads providing primary access to the property. The City Engineer recommends that this bond be in <br /> the amount of$40,000. <br /> 15. The City of Madison shall be listed as an additional named insured on the J&H of Wisconsin,Inc. <br /> liability insurance policy. <br /> Motion carried 7-0. <br /> Motion by Hendrick/Kesterson to fmd that the standards of the zoning ordinance are met and to <br /> approve the Conditional Use Permit as conditioned; carried 7-0. <br /> g. CUP 1479,Ladopoulos,Town of Westport,2/24/98 <br /> Motion by Hendrick/Kesterson to impose the following conditions: <br /> 1. The applicant shall meet all conditions of Town of Westport approval,as specified in Town Resolution 98-6 <br /> (dated 2/16/98). <br /> 2. The site shall be developed according to the site plan received on 2/27/98,except that(a)the gasoline pumps <br /> and car wash shown on the plan shall not be developed until appropriate commercial zoning and conditional use <br /> permits are obtained for such uses and(b)all proposed handicapped accessible spaces shall meet ADA size <br /> standards. <br /> 3. The number of residential units on the property shall not exceed 44. <br />
