The operator shall submit to Dane County an erosion <br /> control plan covering the CUP area for the duration of <br /> operations, and receive approval of an erosion control <br /> permit prior to commencing extraction operations in <br /> Areas 3 and 4 on the site plan. <br /> 3 . The operator shall develop and operate the site <br /> according to the site and operation plan received <br /> 2/26/98 . <br /> 4 . All operations shall cease and the entire site shall be <br /> reclaimed by December 7, 2001, according to the <br /> Reclamation Plan received 2/26/98 . Extraction of <br /> materials in Area 4 shall not begin until Area 3 is <br /> reclaimed. <br /> 5 . Trucks shall access the site from the designated service <br /> road only. All drive aisles shall be maintained in a <br /> dust free manner in accordance with local, state, and <br /> federal regulations . <br /> 6. The site shall be signed "no trespassing." When the <br /> extraction site is not open, the access road shall have <br /> gates securely locked. <br /> 7 . Hours of operation shall be from 7 : 00 a.m. to 4 : 30 p.m. , <br /> Monday through Friday, unless otherwise provided through <br /> the agreement between the operator and the town. <br /> 8 . There shall be no blasting or drilling on the site. <br /> 9 . There shall be no bulk fuel stored on the site. <br /> 10 .No water shall be removed from the site in order to <br /> maintain groundwater discharge to adjacent areas . <br /> 11 . The operator shall spray the site with water if and when <br /> needed to control dust . <br /> 12 . The operator shall require all trucks, excavation, and <br /> other equipment to have muffler systems which meet or <br /> exceed then current industry standards for noise <br /> abatement . <br /> 13 . The applicant shall meet DNR standards for particulate <br /> emissions as described in NR 415 . 075 and 415 . 076, Wis . <br /> Adm. Code. <br /> 14 . J&H of Wisconsin, Inc. shall provide a surety bond or <br /> other mutually acceptable financial assurance to the <br /> City of Madison to ensure maintenance of, and any <br /> required repair to, Sprecher Road and the unnamed <br /> service road resulting from the frequency of travel and <br /> normal hauling weights on said roads providing primary <br /> access to the property. The City Engineer recommends <br /> that this bond be in the amount of $40, 000 . <br />
