} <br /> AGREEMENT <br /> THIS AGREEMENT is made on Odsz_7, E, 020 / 9 9 , <br /> 7 <br /> 1993, by and between J & H OF WISCONSIN, INC., W 1449 Alpine Road, Brooklyn, <br /> Wisconsin 53521 ("J & H"), and the TOWN OF BLOOMING GROVE, a municipal <br /> corporation, 3325 Thurber Avenue, Madison, Wisconsin, 53711 ("Blooming Grove"). <br /> RECITALS <br /> WHEREAS, J & H has filed an application for a zoning change and conditional <br /> use permit, Rezone Petition # 5750 and Conditional Use Permit No. 1102'(CUP <br /> 1102), respectively; and has proposed to remove minerals (clay, topsoil, clean fill) <br /> on property located in Blooming Grove and legally described on attached Exhibit A <br /> (Property); <br /> WHEREAS, J & H and Blooming Grove are mutually concerned about the <br /> conditions and requirements for proposed operation of such mineral extraction <br /> removal on the Property and desire to enter into this Agreement relating to such <br /> conditions and requirements. <br /> NOW, THEREFORE, in consideration of Blooming Grove's approval of Rezone <br /> Petition # 5750 and CUP 1102 and the following terms, covenants and conditions, the <br /> parties agree as follows: <br /> -1- <br />
