3. Granting of Local Approval. Upon approval and execution of this <br /> Agreement by Blooming Grove, Blooming Grove shall give written notice to the <br /> Agriculture, Environment & Land Records Committee of Dane County of Blooming <br /> Grove's approval of zoning change # 5750 and CUP 1102 on the terms and subject to <br /> the conditions of the Agreement. <br /> 4. Enforcement. In the event J & H fails to make any payments due to <br /> Blooming Grove under this Agreement, or materially breaches any of the material <br /> provisions of this Agreement or the conditions and restrictions set forth in attached <br /> Exhibit B made a part hereof, and fail to cure such default within thirty (30) days <br /> after written notice from Blooming Grove to J & H specifying such default, then <br /> Blooming Grove may terminate this Agreement and commence proceedings to revoke <br /> zoning change # 5750 and CUP 1102. If any default by J & H (except for nonpayment <br /> of any payments due to Blooming Grove under this Agreement) cannot reasonably be <br /> cured within the appropriate 30-day period, then J & H shall have such additional time <br /> as is reasonably required to cure such default provided that J & H has commenced to <br /> cure such default within the appropriate 30-day period and is diligently proceeding to <br /> cure such default. <br /> The conditional use permit shall provide that such permit may be revoked by <br /> reason of J & H's uncured default of this Agreement or the conditions and restrictions <br /> set forth in attached Exhibit B made a part hereof. <br /> -3- <br />
