• <br /> Additionally, the parties agree that Blooming Grove shall have the right to enforce <br /> this Agreement by commencement of an action in Dane County Circuit Court. <br /> 5. Conditions and Restrictions. J & H agrees that the conditions and <br /> restrictions set forth in attached Exhibit B are specifically made to CUP 1102 which <br /> J & H is required to obtain under Dane County ordinances. The restrictions set forth <br /> in attached Exhibit B shall run with the Property during the term of the Agreement, <br /> be binding upon J & H and its assigns, heirs and successors, and be enforceable by <br /> Blooming Grove. J & H shall deliver to Blooming Grove a recordable Agreement <br /> Restricting Property in the form of attached Exhibit C. <br /> 6. Access. The Meisters shall be permitted continued access over the J & <br /> H property to their adjoining property depicted in Exhibit D for use of that property <br /> in its current use. Within 90 days of the commencement of this Agreement, J & H <br /> shall grant an easement to the Meisters for access to the property in Exhibit D for use <br /> of that property in its current use. <br /> 7. Financial Assurance. J & H will provide financial assurance in the <br /> amount of $150,000 to Blooming Grove to ensure that it performs its obligations <br /> under this Agreement regarding the repair and maintenance of Sprecher Road. Said <br /> assurance shall be in the form of a bond, letter of credit, escrow account or other <br /> mechanism approved by Blooming Grove. <br /> -4- <br />
