CLAY, TOPSOIL, CLEAN FILL REMOVAL ONLY <br /> Only clay, topsoil and clean fill can be removed from the above-described Property <br /> and only in conformance with the conditions and restrictions set forth herein. No <br /> other minerals such as gravel and rock shall be extracted. <br /> OPERATION <br /> Material removal shall be limited to Monday through Friday from 7:00 a.m. - <br /> 4:30 p.m. However, in the event that the City of Madison requests in writing that <br /> clay be removed on Saturday, such removal shall be permitted from 7:00 a.m. - <br /> 4:30 p.m. No blasting shall be conducted. Material shall not be excavated within <br /> 1000 feet of Door Creek and on mapped wetlands area. Finally, the excavation <br /> activities will be operated in conformance with the Surface Water Management and <br /> Erosion Control Plan dated August 1993; attached hereto as Exhibit A. <br /> J & H shall supply Blooming Grove with the telephone number of the supervisor <br /> of the contractor performing the excavation activities. <br /> -2- <br /> • <br />
