J & H shall have a "flag-person," to the extent authorized by applicable laws, at the <br /> intersection of Sprecher Road and the unnamed Town Road from 7:00 a.m. to 8:30 <br /> a.m. whenever major trucking is occurring during those time periods. For purposes <br /> of this paragraph, major trucking means greater than 8 trucks being utilized for <br /> hauling purposes. <br /> RECLAMATION <br /> When the minerals have been removed, or within twelve (12) months of the expiration <br /> or revocation of the Conditional Use Permit, whichever is the earlier, the Property <br /> will be reclaimed pursuant to NR504.05(l0)(e) which references Section 208.3 of the <br /> Wisconsin Department of Transportation Standard Specifications for Road and Bridge <br /> Construction; copies of which are attached hereto as Exhibit C. The final grades are <br /> set forth in the Surface Water and Erosion Control Plan, dated August 1993, attached <br /> hereto as Exhibit A. No back-hauling of any material shall be permitted. After <br /> reclamation, J & H shall follow DNR guidelines regarding reclamation, to the extent <br /> they exist, for returning the property to agricultural purposes. <br /> ENFORCEMENT <br /> Any written agreement entered into by and between J & H and The Town of Blooming <br /> Grove relating to the CUP area is made applicable to CUP 1102 and any uncured <br /> default of such agreement may be sufficient grounds for revocation of CUP 1102. <br /> -5- <br />
