• <br /> TOWN ROADS <br /> Prior to the commencement of operations, J & H shall reimburse the Town for the <br /> costs of paving the service road, using a 3-inch thick base, to a width of 22 feet with <br /> a 45-foot turn around on the east end; said reimbursement shall not exceed the <br /> $17,000 estimate attached hereto as Exhibit B. J & H shall be responsible for the <br /> repair of the service road and Sprecher Road from the service road to Highway T <br /> caused by mineral extraction activities during the term of operations. At the <br /> termination of this Agreement or the termination of operations, J & H shall repair any <br /> damage to the service road and Sprecher Road from the service road td Highway T <br /> caused by mineral extraction activities during the term of operations. <br /> Further J & H acknowledges that said repairs do not constitute an assessment <br /> under § 66.60, Stats. and Blooming Grove maintains its assessment powers. <br /> TRUCKING <br /> It is required that all trucks hauling from the CUP area, when exiting from the CUP <br /> area, shall use the truck route described as Sprecher Road, North (only) from service <br /> road to County Hy. T. Trucking shall not occur during the winter/spring road break <br /> up as determined by Blooming Grove. Additionally, J & H shall reimburse the Town <br /> for the reasonable costs associated with the placement of two (2) truck entrance signs <br /> and one (1) dead end sign. <br /> -4- <br />
