Operation. <br /> (a) Mineral removal shall be limited to Monday through Friday from <br /> 7:00 a.m. to 4:30 p.m. However, in the event that J & H requests in writing that <br /> Minerals be removed on Saturday, such removal shall be permitted from 7:00 a.m. <br /> to 4:30 p.m. No blasting shall be conducted on the Property. Minerals shall not <br /> be removed within 1,000 feet of Door Creek and on any mapped wetlands area. <br /> The excavation activities will be operated in conformance with the Surface Water <br /> Management and Erosion Control Plan dated August 1993, attached as Exhibit B, <br /> and the map attached as Exhibit C. <br /> (b) J & H shall supply Blooming Grove with the telephone number of the <br /> supervisor of the contractor performing the Mineral removal activities. <br /> 9. Dust Control. J & H shall make every effort to control dust arising from <br /> the Mineral removal operation on the Property, including using a water wagon and a street <br /> sweeper as necessary to control dust. Upon notice from Blooming Grove, J & H shall <br /> temporarily cease removal activities, if reasonably required, to control dust. <br /> 10. No Landfill. No landfill activities shall occur on the Property. <br /> 11. Trucking. Trucks transporting Minerals from the Property shall not use <br /> Blooming Grove roads. Such trucks shall exit the Property by way of the service road <br /> on the Property to Sprecher Road, and then north on Sprecher Road to County <br /> Highway T. <br /> 12. Reclamation. Upon the removal of Minerals or within twelve (12) months <br /> of the expiration or revocation of CUP 1478, whichever occurs earlier, the Property shall <br /> be reclaimed in conformance with CUP 1478, the map attached as Exhibit C, and federal, <br /> state and local laws, regulations, ordinances, including but not limited to, section NR <br /> 504.09(2)(e), Wis. Administrative Code, and section 208.3 of the Wisconsin Department <br /> of Transportation Standard Specifications for Road and Bridge Construction. The final <br /> grades will be as set forth in the Surface Water and Erosion Control Plan, dated August <br /> 1993, attached hereto as Exhibit B. No back-hauling of any material shall be permitted. <br /> After reclamation, J & H shall follow Wisconsin Department of Natural Resources <br /> reclamation guidelines for returning the Property to agricultural purposes. <br /> 13. Access to Meister Property. Paul and Kathryn Meister(the "Meisters")shall <br /> be permitted reasonable access over the J & H property to their adjoining property, which <br /> is depicted in Exhibit D (the "Meister Property").
