All trucks hauling from the CUP area shall use the truck route described as <br /> Sprecher Road north to CTH T, and shall not occur during the "winter/spring road <br /> break up as determined by Blooming Grove." <br /> 12. When the minerals have been removed, or within 12 months of expiration of the <br /> CUP, the property will be reclaimed according to "Wisconsin department of <br /> transportation standard specifications for road and bridge construction." Final <br /> grades are set forth in the "Surface Water and Erosion Control Plan, dated August <br /> 1993." <br /> E. The current request(CUP 1478) was to ZNR public hearing on February 24. In its <br /> original staff report, staff requested additional information and input from the Town and <br /> City of Madison. Those requests have now been satisfied. <br /> II. ANALYSIS <br /> A. The operator has been extracting clay from the site since 1994. The clay is used to cap <br /> landfills. Although the existing CUP is for 150 acres, clay extraction has actually <br /> occurred or is proposed on about 90 acres. This difference results partially from a <br /> prohibition on extraction within wetland areas on the property. Clay has been removed <br /> from 50 acres thusfar, with 45 acres already reclaimed for farming (see Exhibit A). <br /> During the proposed 3 year extension, the operator would intend to open up the final 40 <br /> acres in two phases. These two phases are located in the western part of the CUP area. <br /> The property is provided access to Sprecher Road via a paved service road just south of <br /> I-94. That road is a public right-of-way now within Madison's jurisdiction. <br /> B. Exhibit A is the operations plan for the property. It shows the total area where <br /> extraction has occurred and will occur and the final 40 acres in which extraction <br /> activities are expected to occur, shown in two phases as Area 3 and Area 4. It also <br /> shows that extraction activities come no closer than 500 feet from the western and <br /> southern property line of lands owned by J&H. The service road accesses the northwest <br /> edge of the property. The dark shaded areas are wetlands, which the applicant has an <br /> agreement with DNR not to negatively impact. Door Creek is located roughly 1/2 mile <br /> east of Areas 3 and 4. <br /> C. Exhibit B is the operator's reclamation plan for the property. It shows projected <br /> restoration grades. The operator indicates that actual finish grades can vary to some <br /> extent based on the amount of clay extracted. The operator also notes that restoration <br /> grades may also change somewhat based on its agreement with DNR, which states that <br /> operations/reclamation may not increase or decrease surface water flow to the wetlands, <br /> or the speed which water reaches the wetlands. <br /> D. The Town of Blooming Grove Land Use Plan identifies the majority of the subject <br /> property as within an Agricultural Preservation Area. The Plan shows the southeast <br /> corner of the subject property as a resource protection area along the Door Creek. The <br /> Dane County Parks and Open Space Plan shows this same area as part of the proposed <br /> Blooming Grove Drumlin Resource Protection Area, which extends 3+miles southwest. <br /> E. The County Conservationist has reviewed this request with regard to the County's <br /> erosion control requirements. His recommendations are included as Exhibit C. <br />
