COMPOSITE REPORT-Page 4 Application No. CUP 1478 <br /> F. The subject property is in the area included in January 1998 as part of the City of <br /> Madison's Sprecher Neighborhood Development Plan. The Neighborhood <br /> Development Plan recommends the long-range use of the property as a mix of <br /> office/commercial development and medium density residential (6-12 units per acre). <br /> The subject property is part of an urban service area expansion request now pending <br /> before the RPC. The service drive to the subject property is on lands now within <br /> Madison, as is the majority of Sprecher Road. The operator has met with City of <br /> Madison Planning staff on this request. City staff's comments and recommended <br /> conditions are included as Exhibit D. <br /> G. On February 24,the Blooming Grove Town Board recommended approval of this <br /> request subject to the following condition: "The execution of an agreement between the <br /> Town of Blooming Grove and J&H of Wisconsin, Inc., regarding the conditions and <br /> requirements of the clay extraction, in a form approved by the Town Attorney." <br /> III. CONCLUSIONS <br /> A. The operator is proposing a three year extension on an existing clay extraction site in <br /> the Town of Blooming Grove, initially granted a permit in 1993. It would be reasonable <br /> to allow this time extension to occur. The area directly south of the subject property <br /> could begin to develop with urban residential uses in the next 1-2 years. <br /> B. The ZNR Committee may consider approval of this request subject to the following <br /> conditions: <br /> 1. The Town of Blooming Grove and J&H of Wisconsin, Inc. shall execute an <br /> agreement regarding the conditions and requirements of the clay extraction, in a <br /> form approved by the Town Attorney. The operator shall provide a copy of that <br /> signed agreement to the County Zoning Administrator. <br /> 2. The operator shall submit to Dane County an erosion control plan covering the <br /> CUP area for the duration of operations, and receive approval of an erosion control <br /> permit prior to commencing extraction operations in Areas 3 and 4 on the site plan. <br /> 3. The operator shall develop and operate the site according to the site and operation <br /> plan received 2/26/98. <br /> 4. . All operations shall cease and the entire site shall be reclaimed by December 7, <br /> 2001, according to the Reclamation Plan received 2/26/98. Extraction of materials <br /> in Area 4 shall not begin until Area 3 is reclaimed. <br /> 5. Trucks shall access the site from the designated service road only. All drive aisles <br /> shall be maintained in a dust free manner in accordance with local, state, and <br /> federal regulations. <br /> 6. The site shall be signed"no trespassing." When the extraction site is not open, the <br /> access road shall have gates securely locked. <br /> 7. Hours of operation shall be from 7:00 a.m. to 4:30 p.m., Monday through Friday, <br /> unless otherwise provided through the agreement between the operator and the <br /> town. <br />
