Q- t <br /> • • <br /> Notice For Proposed 401 WQ Certification <br /> Number 3-SC-97-3114LR <br /> 4C Investments, LLC, 2398 Sheridan Drive, Madison, WI 53704 has filed an application with the Wisconsin Department <br /> of Natural Resources for water quality certification under Section 401, Federal Clean Water Act, and Chapter NR 299, <br /> Wisconsin Administrative Code. <br /> The project is located between CTH CV and the Chicago, Milwaukee, St. Paul, and Pacific Railroad, in the Town of Burke, <br /> Dane County, in the SEY of the NE% of Section 19, Township 8 North, Range 10 East. <br /> The project consists of construction of a road through wetlands for access to a proposed commercial and light-industrial <br /> development. The applicant must notify the Wisconsin Department of Natural Resources of his intent to start the discharge at <br /> least five business days prior to the beginning of the discharge. Within 5 business days after the completion of <br /> the discharge, the applicant must notify the Department of Natural Resources of the completion of the discharge. <br /> 2. The applicant must allow the Wisconsin Department of Natural Resources reasonable entry and access to the <br /> discharge site to inspect the discharge for compliance with the certification and applicable laws. <br /> 3. The applicant is responsible for obtaining any permit or approval required by municipal zoning ordinances or by <br /> the Corps of Engineers before starting the project. <br /> 4. Authorization hereby granted by the Department is not transferrable. <br /> 5. - Erosion control must be installed and maintained to prevent erosion into the wetland during construction. <br /> NOTICE OF APPEAL RIGHTS <br /> Any person whose substantial interest may be affected by the Department's determination may request a contested hearing <br /> by serving a petition for hearing pursuant to the requirements of Section 227.42, Wisconsin Statutes, on the Secretary of <br /> the Department within 30 days after publication. <br /> This determination becomes final in accordance with the provisions of NR 299.05(7), Wisconsin Administrative Code, and <br /> is judicially reviewable when final. For judicial review of a decision pursuant to Sections 227.52 and 227.53, Wisconsin <br /> Statutes, you have 30 days after the decision becomes final to file your petition with the appropriate circuit court and to <br /> serve the petition on the Secretary of the Department of Natural Resources.
