• <br /> DANE COUNTY DEPARTMENT OF PLANNING & DEVELOPMENT <br /> PETITION NUMBER 7149: ROBIN CARLEY dba 4C INVESTMENTS, LLC <br /> STAFF REPORT <br /> A. BACKGROUND <br /> Mr. Carley is requesting the rezoning of approximately one-third of an acre from the <br /> shoreland/inland wetland district to non-wetland. Mr. Carley's firm, 4C Investments, intends to <br /> develop a light manufacturing and commercial service park on approximately 75 acres of land in <br /> the Town of Burke. The wetland rezoning would allow the applicant to fill a portion of the <br /> wetlands to provide an access road to the facility. <br /> B. GENERAL SITE & LOCATIONAL INFORMATION <br /> The property is located in the SE 1/4 of the NE 1/4, Section 19 of the Town of Burke, with <br /> approximately 1300 feet of frontage on the east side of County Highway CV. The property lies <br /> between Highway CV and the Dane County Regional Airport. The entire 75-acre parcel is <br /> currently zoned C-2. A cropped agricultural field lies to the south and a commercial parcel on <br /> the north. The site has been used in the past as a demolition landfill. <br /> C. ENVIRONMENTAL FEATURES <br /> The Wisconsin Wetland Inventory shows approximately 50 acres of wetland on the property. As <br /> part of their application for a U.S. Army Corps of Engineers wetland fill permit and WI DNR <br /> clean water certification, 4C investments hired Mead& Hunt, an engineering firm,to conduct a <br /> wetland delineation for the site. Wetland delineations are performed by a detailed analysis of the <br /> soil, vegetation and hydrological conditions on the site, and if done correctly, are generally <br /> considered more accurate than the aerial photography methods used to develop the DNR <br /> Wisconsin Wetland Inventory maps. Chapter NR 115 of the Wisconsin Administrative code, <br /> which governs county regulation of wetlands, contains provisions to allow for updating the <br /> Wisconsin Wetland Inventory, with DNR approval, as delineated data becomes available. <br /> Mead&Hunt's analysis shows a much smaller area(approximately 9 acres) of wetland on the <br /> property than what is depicted on the Wisconsin Wetland Inventory maps (see sketch map, <br /> attached). This delineation has been confirmed by the DNR. 4C Investments proposes filling <br /> approximately one third of an acre of wetland,while removing demolition debris and restoring <br /> natural vegetation on an additional half-acre of wetland. Mead&Hunt found the quality of <br /> wetlands varied across the site, from approximately .85 acres of undisturbed wet meadow in the <br /> north, to highly degraded wetland fragments in the south. <br /> D. COMPLIANCE WITH COUNTY ORDINANCES <br /> Commercial and light industrial activities are permitted uses in the C-2 district. <br /> Sections 11.07 and 11.08 of the Dane County Code prohibit commercial or residential road <br /> construction in the shoreland or inland wetland districts. Section 11.10 of the Dane County Code <br /> allows the County to re-zone land in the shoreland or inland wetland districts if the County <br /> Board determines that the proposed rezoning will not result in a significant adverse impact on <br /> any of the following: <br />
