LEGAL DESCRIPTION: There are two bearings (highlighted on enclosed copy) which
are irregular. Please provide a corrected legal description.
SPECIAL EXCEPTION PERMIT: Your site contains what appears to be a navigable
stream. Under the County shoreland regulations, any filling or grading within 300 feet of
a navigable stream requires a special exception permit from the County Board of
Adjustment. You can apply for a Special Exception Permit at the County Zoning
counter.
TRANSPORTATION ISSUES: I spoke with Pam Dunphy with the County Highway
Department, who indicated that that department would likely require improvements to the
intersections of Willow Road and CTH M. If such a recommendation is made, such
improvements will likely be a condition of CUP approval.
Please provide all information requested above no later than February 16, 1998. You can
call me at 266-4021 or Kris Schutte at 266-9084 if you have questions or need more
information.
I would also like to take this opportunity to address another petition pending before the
town and county--Rezone Petition 7096/CUP 1470. Please be aware that my analysis of
that request showed DNR delineated wetlands on the northeast corner of the site.
Virtually no type of development is permitted in wetland areas. If you wish to build in the
mapped wetland area, you will have to petition the County to have the property rezoned
out of wetlands, and have that request approved. County approval should be preceded by
either a DNR determination that the property is in fact not wetland, or a permit from the
U.S. Army Corps to fill the wetland.
Sincerely,
Mark Roffers
Senior Planner
enclosures
cc: Kris Schutte, Zoning Inspector
Pam Dunphy, Highway Engineer
