Y <br /> D. ENVIRONMENTAL FEATURES <br /> The property is within 50 feet of Token Creek to the southeast, and within 150 feet of an <br /> unnamed,navigable stream to the northwest. The Wisconsin Wetland Inventory shows large <br /> wetland complexes associated with each stream. A small portion of the wetlands associated with <br /> Token Creek appear to extend onto the southeastern edge of the property, approximately 175 feet <br /> from the nearest building (see attached sketch map). <br /> The Dane County Soil Survey shows the soils on the property belong entirely to the Dresden, <br /> Kegonsa and Otter soil types. Because of the typically high water tables in such soils,these areas <br /> are susceptible to groundwater contamination and are usually considered unsuitable for septic <br /> system installation. The presence of wetlands on the site is also consistent with a shallow soil <br /> depth to groundwater. Because of these conditions, animal waste should ideally be disposed off <br /> the site. The current operators of the kennel, Mr. and Mrs. Meyer, have a contract with BFI to <br /> collect and dispose of animal waste. <br /> E. COMPLIANCE WITH COUNTY ORDINANCES <br /> Section 10.126 (7)(b) of the County Zoning Ordinance requires that kennels meet a minimum <br /> setback of 100 feet from a residential zoning district. The .89 acre, R-3A parcel that is proposed <br /> to be rezoned is approximately 50 feet from the existing kennel building. Rezoning this parcel to <br /> A-2, as requested, would allow the kennel to meet the minimum setback. <br /> Section 10.126 (3)(o), (t) and (u) of the zoning ordinance allow kennels, retail sales of pet <br /> supplies and dog training as separate conditional uses in the A-2 district. As legal, <br /> nonconforming uses,the existing kennel and training operation are allowed to continue but <br /> cannot legally expand without an approved conditional use permit. Retail sales were not part of <br /> the original nonconforming use, so also cannot legally take place without a CUP. <br /> F. COMPLIANCE WITH STATE STATUTES AND REGULATIONS <br /> Chapter COMM 83 of the Wisconsin Administrative Code requires that all buildings designed <br /> for human occupancy be provided with either a public sewer connection or a code-compliant on- <br /> site wastewater treatment system. In 1988, the property on which the kennel sits was rezoned to <br /> the A-2 district to allow for a caretaker residence attached to the kennel building. Jim Clark, <br /> Director of Environmental Health, has expressed the opinion that since the building was formerly <br /> used only for animal, not human occupancy,the septic system should have been brought into <br /> compliance with current code requirements at that time. The Department of Environmental <br /> Health has no record that this was done. <br />
