Page 1 DANE COUNTY CONDITIONAL USE PERMIT #1418 THE ZONING AND NATURAL RESOURCES COMMITTEE OF THE DANE COUNTY BOARD PURSUANT TO SECTION 10.255 (2) OF THE DANE COUNTY CODE OF ORDINANCES DOES HEREBY: GRANT the conditional use permit subject to conditions. FOR: Mineral extraction site. EFFECTIVE DATE OF PERMIT: 1/20/98 EXPIRATION DATE: 7/20/2001 THE CONDITIONAL USE SHALL BE LOCATED ON THE PROPERTY DESCRIBED AS FOLLOWS: A parcel of land located in the NE 1/4 of the NE 1/4 of Section 3, Town of Roxbury described as follows: Commencing at the Northeast corner of said Section 3; thence South 400 feet to the point of beginning; thence continue South 850 feet; thence West 550 feet; thence North 850 feet; thence East 550 feet to the point of beginning. CONDITIONS: These conditions are specifically made applicable to this permit, any violation of such conditions shall be sufficient grounds for revocation of this permit. 1. The applicant shall submit an erosion control plan covering the entire CUP site and the entire area of the existing non-conforming extraction site, and receive approval of an erosion control permit prior to beginning extraction in the CUP site. 2. The applicant shall apply for and receive a special exception permit for all lands proposed for excavation that are within 300 feet of Crystal Lake or the pond to the southeast of the CUP site prior to beginning extraction in such areas. 3. The applicant shall apply for an receive all other required local, state, and federal permits. 4. The operator shall, at his expense, have a qualified professional complete an archaeological survey of the CUP site and submit the results of that survey to the Town Clerk and County Zoning Division prior to beginning extraction on the CUP site. The operator shall also, at his expense, have periodic archaeological inspections performed during removal of top soil layers. The operator shall avoid disturbing any protected archaeological sites.
