Page 2 <br /> 5. Reclamation of both the CUP site and the existing non-conforming extraction site <br /> shall be completed within three and one-half years from the date of CUP approval. <br /> Reclamation shall follow the applicant's reclamation plan dated 1/5/98, except that <br /> the operator shall as part of reclamation provide a suitable base for the relocation of <br /> Mussen Road or raise the road bed of existing Mussen Road only if so directed by <br /> the Town Board. Also, that a revised reclamation plan be submitted that is <br /> consistent with the Committee action of January 20, 1998. <br /> 6. Gravel extraction and crushing shall be allowed only during the first two years after <br /> the date of CUP approval, with removal of gravel from the site and reclamation <br /> allowed during the final year and one-half. <br /> 7. The operator shall post and maintain at all times a bond or irrevocable letter of <br /> credit in favor of the Town of Roxbury and Dane County in the amount of$10,000 <br /> to ensure compliance with the reclamation plan. <br /> 8. Hours of operation shall be from 6:30 a.m. to 6:30 p.m., Monday through Friday, <br /> except that crushing shall not begin before 8:00 a.m. No operations of any kind <br /> shall take place on Saturdays, Sundays, and legal holidays. Crushing shall not be <br /> permitted during June, July, and August. <br /> 9. There shall be no blasting or drilling on the site. <br /> 10. There shall be no bulk fuel stored on site. <br /> 11. The operator and all haulers shall access the CUP site only through those points <br /> designated as entrances on the Site/Operations Plan dated 1/13/98. <br /> 12. The site shall include a five foot fence as shown in the Site/Operations Plan dated <br /> 1/13/98. That fence should be replaced to the west as the edge of the extraction <br /> area moves in that direction. During operations, the edge of the extraction area <br /> shall be maintained at a slope no greater than 1:1. The site shall be signed"no <br /> trespassing." <br /> 13. No water shall be pumped or otherwise removed from the site in order to maintain <br /> groundwater discharge to adjacent areas. <br /> 14. The operator shall require that all trucks have muffler systems which meet or exceed <br /> the then current standards for noise abatement, and shall require that all excavation <br /> and crushing equipment meet or exceed the then current industry standards for noise <br /> abatement. <br /> 15. The operator shall use spray bars(water)in the crushing process to reduce dust. <br /> Use of spray bars is not required when the temperature is below freezing. The <br /> operator shall spray the site with water if and when needed to control dust. <br /> 16. The operator shall create and maintain throughout the term of the CUP earthen <br /> berms not less than eight feet in height and located as shown on the Site/Operations <br /> Plan dated 1/13/98. The berm shall be seeded. <br /> 17. The operator shall repair any damage to town roads resulting from the mineral <br /> extraction operation, according to an agreement between the operator and town. <br />
