BOARD OF ADJUSTMENT MINUTES <br /> FEBRUARY 23 , 1995 <br /> 4=' <br /> ,.RESENT: Gaskill, Klopp and Dreps <br /> .LSO PRESENT: Reynolds <br /> r ; eeting called to order at 6: 30 P.M. in Room 2-F City-County <br /> :wilding, by Vice Chairman Gaskill to hold Public Hearing by Class <br /> I Notice. <br /> ink s: KLOPP/DREPS to approve minutes of January 19 and January <br /> 26, 1995. Motion carried - 3-0. <br /> #2600. Appeal by Carol Conboy for a variance from required setback <br /> from normal high watermark as provided by Section 11. 03 (2) to <br /> permit porch addition to existing residence as constructed at 3187 <br /> Sunnyside Street in the NE 1/4 SE 1/4 Section 13 , Town of Dunn. <br /> IN FAVOR: J. Peterson OPPOSED: --- COMMUNICATION: DNR, Town <br /> Board. <br /> DREPS/KLOPP to grant variance of 34± feet from required average <br /> , setbacck to normal high watermark of Lake Kegonsa to permit open <br /> porches as constructed to existing residence. <br /> FINDING OF FACT: <br /> { 1) . Porches not included with permit for residential addition <br /> construction. <br /> 2) . Setback consistant with average setback to neighbors to left <br /> side, right side adjoins wetlands with no residences. <br /> 3) . Entire residence is within required average setback from <br /> normal high watermark. <br /> 4) . As long as porches not be enclosed no visionary obstruction to <br /> neighbors. <br /> '01,.7 CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried - 3-0. <br /> #2601. Appeal by A. & L. Welsch and A. & V. Schwartz for a Special <br /> Exception Permit as provided by Section 11. 05 (3) to permit filling <br /> and grading for a mineral extraction within 300 feet of Crystal <br /> Lake located North of 7869 Crystal Lake Road in the NW 1/4 NW 1/4 <br /> Section 2 , Town of Roxbury. <br /> IN FAVOR: F.
