COMPOSITE REPORT-Page 5 Application No. CUP 1418 <br /> suppression measures would be required on trucks and equipment. The applicant <br /> proposes an eight foot berm virtually surrounding the property which would reduce <br /> noise and visual impacts. The ultimate reclamation of both sites would greatly <br /> improve the appearance of the area, which could in turn enhance uses, values, and <br /> enjoyment of other properties in the area. <br /> 3. That the conditional use will not impede orderly development of the surrounding <br /> property. The expansion of this extraction area may make continued residential <br /> development west of the subject property more difficult to achieve in the next few <br /> years. This owner of this residentially zoned property and the CUP area are the <br /> same,however. Ultimately,reclamation of the entire extraction area would <br /> improve this area for additional recreational and residential development, if desired. <br /> 4. That adequate utilities, access roads, drainage, and other necessary site <br /> improvements. Proper erosion control techniques will have to be approved and <br /> maintained to ensure that construction site drainage does not impact surface waters. <br /> Access would be through the existing non-conforming site from Mussen Road, and <br /> should be restricted elsewhere. <br /> 5. That adequate measures are being taken to provide ingress and egress to minimize <br /> traffic congestion. Trucks will have to use town roads to reach the property, <br /> primarily from CTH Y. The town and operator have agreed to enter a contract to <br /> require operator repair of any damage to town roads. <br /> 6. That the conditional use shall comply with all applicable regulations. Erosion <br /> control and special exception permits will be required. According to S. <br /> 10.123(3)(a), the Committee must also consider the following relevant factors when <br /> approving conditional use permits in the A-1 Exclusive District: <br /> a) The statement of purposes of the zoning ordinance and the A-1 District. <br /> b) The potential for conflict with agricultural use. <br /> c) The need of the proposed use for a location in an agricultural area. <br /> d) The availability of alternative locations. <br /> e) Compatibility with existing or permitted use on adjacent lands. <br /> f) The productivity of lands involved. <br /> g) The location of the proposed use so as to reduce to a minimum the amount <br /> of productive agricultural lands converted. <br /> h) The need for public services created by the proposed use. <br /> i) The availability of adequate public services and the ability of affected local <br /> units of government to provide them without an unreasonable burden. <br /> j) The effect of the proposed use on water or air pollution, soil erosion and <br /> rare or irreplaceable natural resources. <br /> G. On October 20, 1997, the Roxbury Town Board recommended approval of the request <br /> and suggested 14 conditions. All of these conditions are reflected in the suggested <br /> conditions for approval below. <br />
