COMPOSITE REPORT=Page 3 Application No. CUP 1418 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS (REVISED 1/14/98) <br /> • <br /> I. BACKGROUND <br /> A. The applicant is requesting a conditional use permit to allow a mineral extraction <br /> operation in the A-1 Exclusive Agriculture District. The applicant intends to excavate, <br /> process, and remove gravel from the site. At the town's request, the proposed site has <br /> been reduced to 9.5 acres from the earlier 10.7 acres by removing its northwest corner. <br /> B. The subject property is in the Town of Roxbury, between Crystal Lake and Fish Lake. <br /> The property is not within an urban service area. <br /> C. This proposal would be an expansion of an existing 10 acre extraction area to the east. <br /> That site is a non-conforming mineral extraction operation established prior to 1969. <br /> D. This CUP request was originally heard at the ZNR Committee's March 25, 1997 public <br /> hearing. Since that time, the applicant has worked with the Town and staff to refine the <br /> proposal, assemble more information, and develop appropriate conditions. Also, in July <br /> 1997,the Board of Adjustment denied the applicant's request for a special exception <br /> permit for filling and grading within 300 feet of Crystal Lake and a navigable pond <br /> southeast of the site. (The edges of the site are within an area where a SEP is required.) <br /> The denial appears to have been related to the applicant's absence at the July meeting. <br /> II. ANALYSIS <br /> A. The subject property is in cropland use. The surrounding area is characterized by <br /> largely seasonal homes near the lakes and agricultural use. One neighborhood is about <br /> 500 feet northeast of the subject property along Crystal Lake. A second neighborhood <br /> of seasonal manufactured homes is emerging west of the subject property. These lands, <br /> starting about 200 feet from the subject property, were rezoned to R-4 in 1995 and <br /> 1996. There is a outstanding petition(#7110)to remove the seasonal restriction on <br /> occupancy in this neighborhood(same applicant/land owner as CUP 1418). <br /> B. During the Town's deliberations on this request, it was suggested that there may be an <br /> archaeological site on the subject property. The Town has recommended that an <br /> archaeological survey be performed before extraction, and inspections be performed <br /> during top soil removal. The County database on Indian mounds shows none within <br /> Section 3, which includes the entire CUP area. There is,however, record of a mound in <br /> the far northwest corner of Section 2, adjacent to Crystal Lake. <br /> C. The applicant intends to extract gravel from the site through use of endloaders and <br /> trucks. The applicant's engineer indicates that no excavating would take place below <br /> the water table. Blasting would not be required. A portable crushing plant would be <br /> used on occasion,but not during peak recreational months (June, July, August) <br /> according to Town suggested conditions. Use of portable fueling tanks has been <br /> considered, as has contracting with a fueling company. The Town and operator have <br /> agreed to hours of operation of 6:30 a.m. to 6:30 p.m.,with no Saturday or Sunday <br /> hours. <br />
