COMPOSITE REPORT-Page 6 Application No. CUP 1418 <br /> III. SUMMARY <br /> A. The main issues surrounding this proposed CUP relate to its potential impacts on <br /> surrounding residential properties and other uses,the roadway network, and water <br /> quality in the adjacent Crystal Lake and a small pond. If it were proposal for an entirely <br /> new site, it would clearly be inappropriate for the area given the surrounding natural <br /> features, residential development, and recreational uses. The proposal,however, is for <br /> an expansion to an existing, exposed non-conforming extraction site which is visually <br /> unappealing and presents potential runoff and safety hazards. If the expansion closely <br /> follows controls suggested through the conditions of approval, and if both the CUP area <br /> and non-conforming site are properly reclaimed in a timely manner,the proposal may <br /> ultimately result in reduced environmental and safety risks and improved neighborhood <br /> conditions. <br /> B. If the ZNR Committee approves this request, it may wish to consider the following <br /> conditions: <br /> 1. The applicant shall submit an erosion control plan covering the entire CUP site and <br /> the entire area of the existing non-conforming extraction site, and receive approval <br /> of an erosion control permit prior to beginning extraction in the CUP site. <br /> 2. The applicant shall apply for and receive a special exception permit for all lands <br /> proposed for excavation that are within 300 feet of Crystal Lake or the pond to the <br /> southeast of the CUP site prior to beginning extraction in such areas. <br /> 3. The applicant shall apply for an receive all other required local, state, and federal <br /> permits. <br /> 4. The operator shall, at his expense,have a qualified professional complete an <br /> archaeological survey of the CUP site and submit the results of that survey to the <br /> Town Clerk and County Zoning Division prior to beginning extraction on the CUP <br /> site. The operator shall also, at his expense,have periodic archaeological <br /> inspections performed during removal of top soil layers. The operator shall avoid <br /> disturbing any protected archaeological sites. <br /> 5. Reclamation of both the CUP site and the existing non-conforming extraction site <br /> shall be completed within three and one-half years from the date of CUP approval. <br /> Reclamation shall follow the applicant's reclamation plan dated 1/5/98, except that <br /> the operator shall as part of reclamation provide a suitable base for the relocation of <br /> Mussen Road or raise the road bed of existing Mussen Road only if so directed by <br /> the Town Board. <br /> 6. Gravel extraction and crushing shall be allowed only during the first two years after <br /> the date of CUP approval, with removal of gravel from the site and reclamation <br /> allowed during the final year and one-half. <br /> 7. The operator shall post and maintain at all times a bond or irrevocable letter of <br /> credit in favor of the Town of Roxbury and Dane County in the amount of$10,000 <br /> to ensure compliance with the reclamation plan. <br />
