COMPOSITE REPORT - Page 3 Application No. 6891 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> BACKGROUND <br /> A. David Atwell, recent owner of 158.7 acres of Al-Ex land in Cross Plains, is <br /> requesting a rezone of two Acres of land. This two acres are on an elevated central <br /> part of 38.7 acres of land he is selling. <br /> B. The 158.7 acres property consists of three quarter quarter sections south of highway J <br /> and one quarter quarter section north of the highway. An intermittent stream tributary <br /> to the Sugar River flows north-west to south-east through the property. It is shown in <br /> the official Floodplain Map. There is a farm house and farm related buildings on the <br /> property. <br /> C. A brief recent history of this property is as follows: <br /> • There was a ' first split' from the 158.7 acres property. A 260 by 175 feet parcel <br /> to the North-East of CTH J was created and a residence was built prior to David <br /> Atwell purchase. <br /> • On January 22 1997, David Atwell filed a rezoning petition (#6863) to create <br /> two buildable 20.2 acre parcels (RH-4) to be sold. (`second and third splits'). <br /> On March 20 1997, David Atwell Inc. bought the 158.9 acres property. <br /> • On April 1 1997, the ZNR Committee approved the petition (#6863) to rezone <br /> the two 20.2 acres lots with the condition that an approriate access easement be <br /> shown on a recorded Certified Survey map. <br /> D. In the present petition, the owner is requesting to create an additional buildable site <br /> north of the previous petition. The owner wants to sell 38.7 acres to a couple who <br /> cannot meet substantial farm income requirements, hence the need for the rezoning. <br /> This will be the `fourth split'. <br /> II. ANALYSIS <br /> A. The intent/purpose stated in the application is: "residence for farm owner". Present <br /> owner states that once he sells the land he `intents to rent the Agricultural land back <br /> on a long-term basis'. <br /> B. The Town voted favorably on the petition on April 17. <br /> C. In regards to the 78.7 acres (20.2 +20.2 + 38.7) used to create three buildable sites , <br /> the owner has written: "These 3 Lots will be deed restricted against future division". <br /> However, to obtain these three buildable lots all the Al-Ex land was taken into <br /> account to comply with the '35 acre rule'.
