COMPOSITE REPORT-Page 2 Application Rezoning 6903 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> L Background <br /> A. The request is for a change of 41.2 acres to R-1 zoning. The applicant is a Limited Partnership <br /> proposing to expand the Carriage Ridge project which is currently under development west of the <br /> proposed rezoning. This property is currently zoned A-2 and a small area of A-1 Ex by action on <br /> zoning petition 5748 which has a restrictive covenant that limits the property to horse boarding <br /> and/or riding stable. Action on this petition will render these past petitions and restrictive <br /> covenant void. <br /> B. The site is located north of CTH M and east of Woodland Drive along a tributary to Six Mile <br /> Creek which drains into Lake Mendota. This rezoning is directly west of Carriage Ridge <br /> Addition. <br /> C. The project needs two approvals prior to rezoning. One is a change in the Farmland <br /> Preservation Plan for the Town of Westport since the property is currently designated <br /> Preservation on the Town/County Plan. The project also needs to have the approval by the <br /> Regional Planning Commission for a change in the Central Urban Service Area(USA) so that this <br /> proposal may be included into the sewer district. The area is already in the Town water service <br /> area in part due to the well site that was part of Carriage Ridge first plat. This project is designed <br /> to have public sanitary service. The staff of the RPC has had a preliminary review of the proposal <br /> and have given some comments to the Town attorney and developer handling the Plan changes <br /> and USA expansions but no application for amendment has been made as of this writing. Upon <br /> approval of and USA for the site and a rezoning such as the one before the ZNR committee, the <br /> project would have to complete a preliminary and final platting procedure. A copy of a <br /> preliminary plat has been included in the application. This proposed location is not part of the <br /> major boundary agreement with the Village of Waunakee, but the Village will have its extra <br /> territorial review during the platting process although it is assumed they will not exercise this <br /> since the area was not included in the boundary agreement. The applicants have submitted a <br /> preliminary plat to Dane County. <br /> II. Analysis <br /> A. The current Town Plan shows this area in Agricultural Preservation. A Plan map change is in <br /> process at the Town. The Town may have already acted on such a change but the item has not <br /> been forwarded to the County as of this writing. Full consideration of a change will require the <br /> Regional Planning Commission consideration and the approval of ZNR and the County Board <br /> after the review period of 60 days is completed and a public hearing is held by the ZNR on the <br /> Plan amendment. The amendment will then need to be approved by the Land and Water <br /> Conservation Board of the State. The Town already has two very small map changes pending at <br /> DATCP which they have not been reviewed as of yet. This additional amendment will probably <br /> be useful in moving all of these changes along. Given the current designation of this area on the <br /> current Plan map as Agricultural, it is unclear how much detail and justification will be necessary <br /> in order to have a plan amendment approved by DATCP. With this in mind, it would be useful to <br /> submit this amendment to DATCP prior to completion of the entire process to see if there are any <br /> significant issues. P &D staff will submit such an amendment as soon as one is submitted to the <br /> county. <br />
