COMPOSITE REPORT- Petition No. 6916 <br /> ZNR Work Meeting 8/11/98 Town of Deerfield <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> includes 8/11/98 revisions (crossed out or underlined) <br /> I. BACKGROUND <br /> A. The applicants are requesting to rezone 1.5 acres of their 36 acres property in the town <br /> of Deerfield from A-1 EX to R-1A to allow construction of one home. <br /> B. All splits available for the original (1978) farm have been used. The owner has <br /> provided a signed TDR agreement with another owner in Deerfield to be able to build <br /> on the property. <br /> C. Following is a summary of rezones related to the property in question <br /> • 1994: The maximum number of residential lots on the"original"(1978)farm parcel was reached with <br /> the approval of Petition 5997. <br /> •95?: Petition 6392 by Walt Olson was approved but vetoed by Exec. Phelps because it violated town <br /> density policies <br /> •4/96: Petition 6557(slightly different piece of land than 6392)by Olson was approved by Town and <br /> County provided that a"transfer of splits"be executed through a deed restriction on another piece <br /> of Mr. Olson's land elsewhere in Deerfield. The transfer was approved and the deed restriction was <br /> recorded. <br /> •Petition 6916. Approval of Deerfield Town Board. Composite report by RPC staff mentioning <br /> conflict with town/county land use density policies. In reference to the transfer of splits allowed in <br /> petition 6557,the report says: <br /> "If the proposal is to again transfer a residential building site from some other land ownership <br /> in the town, there needs to be public disclosure of this intent for consistent application of this <br /> policy" <br /> •4/97: Submittal of Petition 6916 by Noll • • - • ! . •• •• _ •• • - _ - - <br /> - • - • .•- _ - • •_ -•• • - . .. - - (such <br /> agreement was submitted one year later) <br /> •4/14/97: Town Board approved with no conditions <br /> •5/3/97:Note from County Zoning Staff on importance of knowing acreage and R.O.W. (the <br /> remainder of the Al-EX parcel would be only 35.1 acres). <br /> •5/8/97: Letter of applicant mentioning error in legal description(far from the area to rezone)and <br /> intention of acquiring small area of neighboring land and register change in legal description in the <br /> office. <br /> •5/27/97: Postponed at ZNR Committee <br /> •Town Board denial of zoning petition? <br /> •6/2/97:Applicant's letter asking ZNR Committee members to hold petition 6916 in abeyance <br /> •6/3/97: The ZNR Committee approved to postpone action to a future meeting and request Town of <br /> Deerfield to give reasons for denial. <br />
