COMPOSITE REPORT - Page 3 Application No. 6954/1437 <br /> REVISED DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> BACKGROUND <br /> A. The applicant has requested rezoning from B-1 Local Business to C-1 Commercial, <br /> along with a conditional use permit, to allow a tavern, outdoor entertainment <br /> activity, and games(horseshoes)lighted to operate at night. The subject property <br /> is at the intersection of USH 12 and CTH K in the Town of Springfield. The <br /> property is in a rural area(no public sewer or water). <br /> B. On July 10, 1997, the County Board approved the proposed rezoning to C-1 after <br /> a favorable recommendation from the ZNR Committee at its June public hearing. <br /> The Town Board also approved the rezoning request at its May 20 meeting. <br /> C. This revised report includes information from the original staff report provided to <br /> the Committee in the June public hearing packet. It is revised to reflect amended <br /> plans provided by the applicant, and to focus directly on the CUP request. <br /> II. ANALYSIS <br /> A. The 1.0 acre subject property is currently developed with a restaurant/tavern <br /> (Sonny's). The site includes approximately 60 stalls of parking in a paved area, <br /> and an additional smaller area of graveled parking with capacity for perhaps 20 <br /> more vehicles. The parcel also contains two horseshoe pits. <br /> B. The surrounding area is characterized primarily by residential uses. There are <br /> residences abutting the subject property to the south and west, and several <br /> additional homes along Highway K to the west. Two homes, another tavern, and a <br /> small mobile park are located across Highway K. <br /> C. The applicant proposes to add a"party patio" on the southwest edge of the subject <br /> property. According to the applicant's revised site plan(Exhibit A), the party patio <br /> would be about 3,400 sq. ft. The entire party patio would be enclosed with a <br /> permanent fence. It would contain a music stage, an outdoor beer garden, a <br /> kitchen/bar shelter, and portable toilets. The facility would be available for private <br /> bookings, such as wedding receptions. It would also be used for public <br /> entertainment and events, such as live music, flea markets, and craft shows. <br /> D. The party patio is significantly reduced in size from the applicant's original <br /> proposal(>9,000 sq. ft.)to meet County parking requirements. The applicant <br /> proposes to provide the required parking through the existing paved area, some of <br /> the existing graveled area, and a small grassed area along the property's southerly <br /> edge. In total 82 parking stalls would be provided on-site, with the majority in the <br /> paved area. Given the parking requirements for the tavern plus those for the party <br /> patio, this is just sufficient to meet zoning ordinance parking requirements. <br /> E. The applicant has identified an approximately 2,200 sq. ft. expansion area for the <br /> party patio. This area would provide space for horseshoe pits. This expansion <br /> may not take place until the applicant is able to provide additional parking, which <br /> is not possible on the current site. The applicant has negotiated lease agreements <br /> with both the property owner directly south of the subject property and the owner <br /> across CTH K to use yard or graveled areas for"special event" parking.
